On September 5, 2014 I was a guest on Neil Cavuto’s program that aired on the Fox Business Network.  The starting point for our conversation was the exceptionally high  unemployment rate in California and the role that illegal immigration plays in this issue.  Reportedly one in ten workers in California are illegal aliens.  During our conversation I noted that Californians for Population Stabilization has been hammering this issue.  In point of fact the website ( ) has posted materials that address the impact of illegal immigration on that beleaguered state and, in fact, the entire United States of America.
However, Neil quickly moved the discussion into the nexus between the failures of the immigration system and the threat of terrorism.

During my appearance on Neil’s program I referenced the categories of aliens who, under the current immigration laws contained in the all encompassing Immigration and Nationality Act (INA) are to be excluded from entering the United States.  It is important to understand just how important that inspections process that is conducted by the CBP (Customs and Border Protection) Inspectors is to national security, public safety and host of other serious challenges and threats America and Americans face today.  

Title 8, United States Code, Section 1182 is that section of law which enumerates the categories of aliens who are to be excluded. Among these classes are aliens who suffer from dangerous communicable diseases or extreme mental illness. Additionally convicted felons, human rights violators, war criminals, terrorists and spies are to be excluded as well as aliens who would seek unlawful employment thus displacing American workers or driving down the wages of American workers who are similarly employed and aliens who would  become public charges.

The immigration laws of the United States are utterly objective and make no distinctions that involve race, religion or ethnicity.

For decades our nation has been failing at its mission of securing our borders and instilling integrity to the entire immigration system which includes the enforcement of our immigration laws from within the interior of the United States and the process by which applications for immigration benefits are adjudicated.  The 9/11 Commission made it clear that these failures enabled not only the 19 terrorists who participated in the attacks of September 11, 2001 to enter the United States and embed themselves as they went about their deadly preparations but many other terrorists who have operated in the United States.  Most recently we saw graphic evidence of this in the April 15, 2013 attack at the Boston Marathon by the Tsarnaev brother who, along with their other family members were granted political asylum in the United States claiming credible fear that they could not safely return to their native Russia.  Shortly after they were granted political asylum they voluntarily boarded airliners for a trip back to Russia.
Our government ignored the obvious indications of fraud.

This is not a new problem, on July 13, 2011 the Washington Times published a truly disturbing article:

The current administration has been the rock bottom worst where immigration law enforcement is concerned however, both political parties are responsible for the fact that there has never been a greater influx of illegal aliens in the United States even as the United States faces existential threats posed by international terror organizations such as ISIS and al-Qaeda.
It is remarkable that the average American has been duped into believing the lies and rhetoric of the politicians who regularly chant the same false phrases repeatedly.  Think about the (false) claim that we must import many more high-tech workers because American schools are incapable of providing effective education where the STEM (Science, Technology, Engineering and Math) courses are concerned.  Consider that the very same politicians who make that claim have also stated that we must “Staple Green Cards onto the diplomas of the foreign students who acquire their educations in the United States!”  If our schools are that inept and incapable, why in earth should seek to employ those foreign students once they get their degrees?
In point of fact, on September 3rd, I was a guest on the NewsMax-TV news program, “America’s Forum” hosted by JD Hayworth to discuss yet another troubling story about yet another screwup by the DHS, an agency I have long referred to as the Department of Homeland Surrender.

The focus of that interview was that fact that the DHS conceded that some 6,000 foreign students had gone “missing” in the United States.  ABC News reported on this in its report,

Here is how this truly disturbing report begins:

 The Department of Homeland Security has lost track of more than 6,000 foreign nationals who entered the United States on student visas, overstayed their welcome, and essentially vanished — exploiting a security gap that was supposed to be fixed after the Sept. 11, 2001 terror attacks.

“My greatest concern is that they could be doing anything,” said Peter Edge, the U.S. Immigration and Customs Enforcement official who oversees investigations into visa violators. “Some of them could be here to do us harm.”

Homeland Security officials disclosed the breadth of the student visa problem in response to ABC News questions submitted as part of an investigation into persistent complaints about the nation’s entry program for students.

ABC News found that immigration officials have struggled to keep track of the rapidly increasing numbers of foreign students coming to the U.S. — now in excess of one million each year. The immigration agency’s own figures show that 58,000 students overstayed their visas in the past year. Of those, 6,000 were referred to agents for follow-up because they were determined to be of heightened concern.

“They just disappear,” said Sen. Tom Coburn, R-Okla. “They get the visas and they disappear.”

Coburn said since the Sept. 11, 2001 terror attacks, 26 student visa holders have been arrested in the U.S. on terror-related charges. 

This bears repeating:

The failures of the immigration system are undermining our national security and posing a threat to public safety- indeed, every terror attack carried out by foreign nationals in the United States including the bombing of the Boston Marathon on April 15, 2013 were only possible because of those failures.
The harsh reality is that the DHS, in my judgement, was concocted to impede any efforts to address those myriad failings of the immigration system.

The starting point for any discussion about immigration must be the findings and recommendations of the 9/11 Commission.  

The 9/11 Commission Report was released more than a decade ago.

Yet there are precious few members of Congress in either the House of Representatives or the United States Senate from either party willing to even mention the fact that there was a 9/11 Commission- when the topic of immigration is raised!

Here are a couple of important quotes to put things in proper perspective:

The first paragraph of the preface of the The 9/11 Commission Staff Report on Terrorist Travel  begins with the following statement:

It is perhaps obvious to state that terrorists cannot plan and carry out attacks in the United

States if they are unable to enter the country. Yet prior to September 11, while there were

efforts to enhance border security, no agency of the U.S. government thought of border

security as a tool in the counterterrorism arsenal. Indeed, even after 19 hijackers

demonstrated the relative ease of obtaining a U.S. visa and gaining admission into the

United States, border security still is not considered a cornerstone of national security

policy. We believe, for reasons we discuss in the following pages, that it must be made


The 9/11 Commission Staff Report on Terrorist travel went on to detail numerous examples of instances where terrorists not only made use of visa and immigration benefit fraud to enter the United States but to also embed themselves in the United States. Page 47 of this report noted:

Once terrorists had entered the United States, their next challenge was to find a way to remain here. Their primary method was immigration fraud. For example, Yousef and Ajaj concocted bogus political asylum stories when they arrived in the United States. Mahmoud Abouhalima, involved in both the World Trade Center and landmarks plots, received temporary residence under the Seasonal Agricultural Workers (SAW) program, after falsely claiming that he picked beans in Florida.

This paragraph is found on page 98 under the title “Immigration Benefits:”

Terrorists in the 1990s, as well as the September 11 hijackers, needed to find a way to stay in or embed themselves in the United States if their operational plans were to come to fruition. As already discussed, this could be accomplished legally by marrying an American citizen, achieving temporary worker status, or applying for asylum after entering. In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.

The importance of our borders and our immigration laws cannot be overemphasized.  In the war on terror and transnational gangs, they are our first line of defense and our last line of defense. They are equally important to American workers who are facing unfair competition from foreign workers, aided and abetted by the administration and advocates for “Sanctuary Cities” and Comprehensive Immigration Reform,
In his historic speech before the 3rd Army on May 31, 1944, General George S. Patton said, on the strategy of holding a position:

We’re not holding anything, we’ll let the Hun do that. We are advancing constantly, and we’re not interested in holding onto anything except the enemy.”

Pushing back against Comprehensive Immigration Reform is the same as holding position. The time has come for us to advance by demanding that our borders be made truly secure and our immigration laws be effectively administered and enforced.

Comprehensive Immigration Reform violates all of the findings and recommendations of the 9/11 Commission but no one is willing to even consider how the lack of real border security and the lack of real integrity to the various components of the immigration system imperil national security and public safety.

The findings and recommendations of the 9/11 Commission must be the starting point for any discussion about immigration legislation.  That commission determined that a lack of border security, including the visa process. and fraud in the immigration benefits program, enabled terrorists to enter and embed themselves in the United States, as they went about their deadly preparations.

Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  Simply stated, the immigration laws were enacted to save lives and protect the jobs of American workers.  In point of fact, our borders and our immigration laws are America’s first line of defense and last line of defense against international terrorists and transnational criminals.
It is not “Anti-Immigrant” to be “Pro-American!”

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!
If our government’s failures to protect American jobs by securing our nation’s borders and effectively enforcing our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

[Watch] One in Ten California Workers is an Illegal Alien, Governor Still Welcomes All

For the unemployed American citizens in the State of California, it’s probably a difficult thing to accept. Ten percent of the available jobs in the state are filled right now by illegal aliens. Those are jobs that would be available to citizens, if our government were protecting us as they are sworn to do.

Michael Cutler, a former INS special agent discusses that statistic with Neil Cavuto. He says he writes for a group, Californians for Population Stabilization, an organization that contends that 98 percent of the growth in population in that state is due to immigration.

Cavuto notes that the unemployment rate in California is reported to be above the national average, in the neighborhood of 8%, but they note that those figures are artificially low, as the more longterm unemployed are deemed to have given up working and are  conveniently no longer included in the statistics.

He says California has two negatives working against them, Jerry Brown and the connection to the Mexican border.

Cutler says the claim that Americans don’t want to do the jobs that the illegals have is false, that Americans would love to have those jobs. He cites experiences as an INS agent in which they would raid factories and immediately upon the word getting out, there would be people lined up to take the jobs.

Cavuto asks why we don’t crack down on the employers, and they discuss politicians on both sides of the aisle who simply throw their hands up and say there are too many illegals to get rid of. They then decide the appropriate remedy is to reward them with some type of legal status.

The correct response is to make them ineligible for employment through jail terms for employers, make them ineligible for benefits through identification verification and case supervision, and provide them a means through which to self-deport. There will be a tsunami of people heading south.

He asks why would anybody take the time and expense to come to America legally when they can simply circumvent the system by coming illegally.

Cutler harkens back to the first four years of his 30 year INS career, detailing how there are specific groups that those who control access to the country are looking for. They include aliens with communicable diseases, mental conditions, sex offenders, violent offenders, convicted felons, human right violators, war criminals, spies and terrorists. He says if someone is sneaking in, there is good reason to suspect that they belong to one of the excluded categories.

Cutler is also very worried about the upcoming anniversary of 9/11 and he relays a chilling incident he was a party to just prior to the 2001 attacks.
