The Language of Choice for the Eight Gangstersâ??

Hi Gang:
I have been following the coverage of the horrific terrorist attacks in Boston this past week.
I keep on thinking about the needless deaths, injuries and suffering of the victims, their families, friends, neighbors and colleagues.
It has transported me back to the terrorist attacks of September 11, 2001 and the similar feelings we had back then.
The 9/11 Commission was convened to try to make certain that this sort of senseless violence would not happen again.  The politicians who stood in front of the cameras and microphones in the wake of the attacks of 9/11 all demanded to know why the “dots had not been connected.”  Many sounded so angry and self-righteous.  They thumped the podium and they thumped their chests demanding answers.
I joined a long list of witnesses at one Congressional hearing after another.
We explained the nexus between immigration and national security.  Those of us who were asked to provide testimony to the 9/11 Commission seized the opportunity to voice our perspectives and concerns.
On March 20, 2013 I was called to appear before yet another Congressional hearing.  This time it was the Senate Judiciary Committee that asked for my insight.
Only three senators appeared intermittently at the hearing but what was important was that I was able to go on the record to explain my concerns about national security and the impact of massive numbers of applications that would be processed without so much as an in-person interview if Comprehensive Immigration Reform was enacted.
Senator Grassley sent me followup written questions and Senator Sessions obviously took note of what I had to say in drafting his own questions for the “Gang of Eight” or, as I have come to refer to them, the “Eight Gangsters.”
This morning I sat down to write a commentary I hope you will help me distribute far and wide and send to as many folks as you can- especially to those who you think disagree with my position.  The first Amendment is not only about Freedom of speech, press and religion but also about the right to seek redress of grievances and the right for peaceable assemblage.  The latter if at the heart of our democracy.  We must stop vilifying each other and have an honest conversation that is fact-based.  Those who disagree are not our enemies but our felow Americans with whom we must sit down and speak honestly and openly.
Below I have provided my testimony, closing statement and questions and my responses concerning my most recent appearance before Congress.

On November 15, 2012 I posted a commentary on the CAPS (Californians for Population Stabilization) website in response to New York’s Senior Senator, Chuck Schumer having cobbled together his “Platform on Immigration Reform” that had four primary planks and proclaimed that he had the solution to the immigration crisis that confronts America and Americans today.
My commentary was entitled:
Finally, my commentary, which I concede is not short, is at the bottom of this e-mail.
Immigration is not a minor issue nor is it a single issue.  Immigration is a singular issue that impacts virtually every challenge and threat America and Americans face today.
Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!The immigration laws are supposed to achieve two primary goals- to protect American lives and protect Americans’ jobs. 

Our nation is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda or other terrorist organizations!

It is also vital that American workers never be made to compete with foreign workers for their jobs!  (This requirement is a component of the Immigration Laws that are not being enforced today!)

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws that are intended to protect our nation and our citizens concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

I also ask that you pass this e-mail along to your friends and neighbors- I am attempting to create a “Bucket Brigade of Truth!”

We the People must make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Immigration Newspeak: The Language of Choice for the Eight Gangsters”

On Sunday, April 21, 2013, just hours after the arrest of Dzhokhar Tsarnaev, one of the bombing suspects in the horrific terrorist attacks carried out by the Brothers Tsarnaev, Schumer had the unmitigated chutzpah to one again step in front of the television cameras to proclaim that Comprehensive Immigration Reform was more important than ever before because it would, according to him, protect Americans from the bad guys who are hiding in the shadows.

These alleged terrorists were not hiding anywhere except in plain sight! They were granted lawful presence in the United States even though the basis for their lawful status was an apparently fraud-laden application for political asylum from which all else flowed.

Someone needs to buy a newspaper for Mr. Schumer and his seven fellow “gangsters” who are determined to foist Comprehensive Immigration Reform on the United States- a program which would do nothing to protect America or Americans but exacerbate obvious threats to national security with the added “bonus” of decimating America’s middle class and working poor!

The Associated Press report posted a brief news report that focused on an appearance by Senators Graham and Schumer on the CNN news program, “State of the Union”

Sens. Graham and Schumer say Boston bombings no excuse for critics to stall immigration bill

The AP report noted, in part:

Republican Sen. Lindsey Graham of South Carolina said Sunday that the bombings that left three dead “should urge us to act quicker, not slower when it comes to getting the 11 million identified,” referring to the estimated number of immigrants living in the country illegally. Democratic Sen. Chuck Schumer of New York added “keeping the status quo is not a very good argument, given what happened” in Boston.

The level of dishonesty in these outrageous statements should boil the blood of every American, irrespective of their political orientation.

What is broken about the immigration system is its pervasive lack of integrity. Of course that term integrity is an anathema to Schumer and his fellow gangsters!

The immigration laws, were enacted to achieve two primary goals- protect innocent lives by enhancing national security and community safety and protect the jobs of American workers.

Clearly the immigration system failed abysmally this past week but not the way that Schumer and his fellow gangsters would have you believe or come to understand.

The administration has been adamant about protecting women who suffer spousal abuse. The Violence Against Victims Act has provisions that create incentives for aliens who are deceiving their United States citizen spouses to lie about being abused to be able to self-petition for residency thereby creating a nightmare, in some instances, for their American husbands and some instances, their American wives.

Yet the elder Tsarnaev, according to news reports, had been charged with spousal abuse against his United States citizen wife, but was never deported.

Alleged terrorists, Tamerlan Tsarnaev and Dzhokhar Tsarnaev, were not hiding in the shadows. In fact, published reports indicated that they and their families gamed the immigration system by filing for political asylum even though it would certainly appear that their parents lied on their applications for asylum.

I make this claim because it is of significance that they have returned to Russia, the country to which they would have claimed in their application for asylum, that they could not safely return.

They made their applications for asylum roughly a decade ago. There has been no regime change in Russia since they applied for and received asylum, yet they willingly returned to Russia of their own volition.

For those of you not familiar with political asylum, the asylum laws were enacted to prevent the return of aliens to their homelands if, in sending them back to their countries of origin, they would face harsh consequences- imprisonment, torture or death because of a “credible fear” that as a result of their race, religion, ethnicity or political views that they would face such dire consequences.

You should know that in the mid-1960’s when I was a president of a local B’nai B’rith chapter while I was a college student, I participated in a couple of demonstrations in Washington, DC outside the White House to ask then President Lyndon Johnson to convince

the leaders of the Soviet Union to permit members of religious and ethnic minorities such as Jews, to leave the Soviet Union to go to those countries that would admit them so that they could practice their religious beliefs in peace.

When I subsequently became an Immigration Inspector in 1971 it gave me great joy to admit refugees into the United States. For me, this closed the circle!

My grandmother from whom I was named was slaughtered in Poland during the Holocaust.

I believe that it is important for the United States to continue to offer safe haven for those who face a similar plight in countries around the world today.

However, there have been numerous instances where criminals and terrorists who have seen in America’s kindness, weakness. They have come to understand that the easiest way to set up shop in the United States is to make their way to the United States, either by running our borders or by entering via a port of entry and then claiming political asylum.

By not investigating these applications and other applications for a wide array of immigration benefits, the United States has provided ample opportunities for criminals and terrorists to gain entry into the United States and then be able to embed themselves.

In January 1993 a Pakistani national by the name of Mir Aimal Kansi stood outside CIA Headquarters with an AK-47 and opened fire on the vehicles of CIA officials reporting for work on that cold January morning in Virginia. When the smoke dissipated, 2 CIA officer lay dead and three other were seriously wounded.

Kansi had previously filed a fraud-laden application for political asylum before those attacks- this application enabled him to remain in the United States and seek gainful employment.

According to published reports, in the weeks before the attacks, he worked as a driver for a courier service which provided him ample opportunities to scope out the CIA complex without calling attention to himself.

Following his brutal attack, Kansi fled the United States and was ultimately brought back to stand trial. He was found guilty and executed for his crimes.

On May 20, 1997 I participated in my first Congressional hearing. That hearing was conducted by the House Subcommittee on Immigration and Claims and was entitled:

VISA FRAUD AND IMMIGRATION BENEFITS APPLICATION FRAUD

Of 94 terrorists who were identified by the 9/11 Commission as operating in our country, in the decade leading up to the terrorist attacks of September 11, 2001, some 59 or roughly two-thirds of them were found to have committed immigration fraud to enter our country and/or embed themselves in our country. You will notice that the first quote I provide from the 9/11 Commission Staff Report on Terrorist Travel makes particular not of the SAW (Seasonal Agricultural Worker) program. Schumer was a key architect of that program as a component of the disastrous amnesty of 1986. He is calling for it to be included in the Comprehensive Immigration Reform legislation.

The following material is actually included in my closing remarks that I provided to the Senate Judiciary Committee when I testified before that legislative body on March 20, 2013:

The 9/11 Commission Staff Report on Terrorist Travel detailed numerous examples of instances where terrorists not only made use of visa and immigration benefit fraud to enter the United States but to also embed themselves in the United States.

To cite an example, page 47 of the above-noted report contained the following paragraph:

Once terrorists had entered the United States, their next challenge was to find a way to remain here. Their primary method was immigration fraud. For example, Yousef and Ajaj concocted bogus political asylum stories when they arrived in the United States. Mahmoud Abouhalima, involved in both the World Trade Center and landmarks plots, received temporary residence under the Seasonal Agricultural Workers (SAW) program, after falsely claiming that he picked beans in Florida.

Mohammed Salameh, who rented the truck used in the bombing, overstayed his tourist visa. He then applied for permanent residency under the agricultural workers program, but was rejected.

Eyad Mahmoud Ismail, who drove the van containing the bomb, took English-language classes at Wichita State University in Kansas on a student visa; after he dropped out, he remained in the United States out of status.”

Although I made note of this in my prepared testimony, for purposes of placing emphasis on this highly significant vulnerability, especially as political pressure appears to be building for the enactment of “Comprehensive Immigration Reform,” a massive amnesty program for unknown millions of illegal aliens present in the United States where there are no resources to routinely conduct face-to-face, in person interviews with these aliens. These aliens seek various immigration benefits that would include providing “undocumented” aliens with official identity documents even though there is no realistic way of determining their true identities or backgrounds or true intentions for entering the United States in violation of law.

In my prepared testimony I quoted from the 9/11 Commission Staff Report on Terrorist Travel and I am compelled to provide these two brief quotes once again:

First of all, here is the first paragraph from the preface of that report:

“It is perhaps obvious to state that terrorists cannot plan and carry out attacks in the United States if they are unable to enter the country. Yet prior to September 11, while there were efforts to enhance border security, no agency of the U.S. government thought of border security as a tool in the counterterrorism arsenal. Indeed, even after 19 hijackers demonstrated the relative ease of obtaining a U.S. visa and gaining admission into the United States, border security still is not considered a cornerstone of national security policy. We believe, for reasons we discuss in the following pages, that it must be made one.”

Here is a paragraph under the title “Immigration Benefits” found on page 98:

“Terrorists in the 1990s, as well as the September 11 hijackers, needed to find a way to stay in or embed themselves in the United States if their operational plans were to come to fruition. As already discussed, this could be accomplished legally by marrying an American citizen, achieving temporary worker status, or applying for asylum after entering. In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.”

This case was also referenced in my testimony:

On March 30, 2010 The United States Department of Justice issued a press release about how a citizen of Eritrea, had pleaded guilty to alien smuggling.

That press release was entitled:

Eritrean Man Pleads Guilty to Alien Smuggling

In order to smuggle these aliens into the United States from as far away as South Africa and East Africa via Latin America and, finally, into the United States, he and his cohorts utilized an extremely sophisticated approach. According to the press release his “Magical Mystery Tour” on some smuggling runs, included passing through Brazil and Venezuela, the latter, a nation not considered a friend of the United States. It causes me to wonder if the government of Venezuela offered any assistance to the smuggler, Samuel Abrahaley Fessahazion, aka “Sami,” aka “Sammy,” aka “Alex” and aka “Alex Williams.”

What is of further concern to me, is the fact that Fessahazion was able to game the immigration system and successfully commit immigration fraud by obtaining political asylum by making a false statements in conjunction with his application for political asylum.

Consider this passage from the press release issued by the Department of Justice:


According to plea documents, from at least June 2007 until approximately January 2008, Fessahazion was the Guatemalan link of an alien smuggling network that spans East Africa, Central and South America. Specifically, Fessahazion illegally entered the United States at McAllen, Texas, on March 20, 2008. He applied for asylum on Sept. 30, 2008, claiming in his application that he was traveling across Africa in 2007 and 2008, fleeing persecution in Eritrea. However, Fessahazion was actually in Guatemala during that period facilitating the smuggling of East African aliens to the United States.

Fessahazion was granted asylum by the United States on Nov. 13, 2008.


Yet Fessahazion, an illegal aliens with an apparent penchant for using false names, ran our nation’s border, claimed political asylum and was then rewarded by being granted political asylum and, in so doing was potentially placed on the pathway to United States citizenship!

Here are some additional thoughts about the Fassahazion debacle:

If he had not been able to con the bureaucracy at USCIS (United States Citizenship and Immigration Services) it is entirely possible he would not have been able to remain in the United States or travel freely across our borders, an ability he gained when the agency charged with maintaining the integrity of the immigration benefits program failed, yet again!

According to the press release, Fessahazion, himself, ran our nation’s border on March 20, 2008 and then he applied for political asylum roughly 6 months later. He had either studied our immigration “system” or had been well coached. In any event, in under six weeks he was granted political asylum!

I have to repeat this to make certain you did not miss what I just wrote. Fessahazion was granted political asylum just 6 weeks after he applied for asylum even though he claimed to have been facing persecution in Eritrea, nearly half way around the world!

Meanwhile the investigation disclosed that while he claimed he was fleeing persecution in Eritrea, he was apparently dodging law enforcement in Guatemala as he smuggled East African aliens through that country en route to the United States!

There was also not a word in the DOJ press release about any efforts being mounted to identify or locate and apprehend the smuggled aliens who paid quite a bit of money to be smuggled into the United States from half-way around the world, from a part of the world, in fact, where terrorist and extremist groups are becoming ever more powerful and influential.

It is clear that Fessahazion committed fraud on his application for political asylum, yet there was not a word in the press release about any consideration being given to prosecuting him for committing immigration fraud in his application for political asylum, nor is there any indication that efforts will be made to strip him of his lawful status based on his fraudulent application for political asylum. This is extremely important because as an individual who had been granted political asylum, it is unlikely that any efforts will be made to deport him from the United States after he serves his prison sentence for alien smuggling (presuming he is sentenced to serve jail time.) Think of how many vicious criminals are not deported when such thugs have been granted political asylum because of “humanitarian” considerations.

Considering that Fessahzion lied on his application for political asylum, there would be no reason to not deport (remove him) from the United States if he lost his status as an alien who had been granted asylum.

While Schumer and his cohorts claim that the immigration system is broken, his concern is not on how to make certain that the immigration system be made to address national security and the well-being of American workers and their families, but how he can get the immigration system to import still more foreign workers more quickly and with fewer impediments at a time of record levels of American poverty and foreclosures on their homes!

The key issue that must be addressed is the lack of integrity to the immigration system!


It is that lack of integrity that enabled the Brothers Tsarnaev to remain in the United States for a decade under the color of law despite the immigration fraud that their family committed that went undetected and unpunished.

Comprehensive Immigration Reform would not do one iota to improve the integrity of this inept and incompetent system and must be comprehensively rejected!

Once again I will make the point that what is needed is ComPILE (Comprehensive Immigration Law Enforcement)!
