"New York Mayor Bloombergâ??s Inconsistent Immigration Policies Defy Logic"

Hi Gang:
My focus today is a commentary I wrote for CAPS (Californians for Population Stabilization) that was posted earlier today on their website.  As you will see, the enforcement and administration of America’s immigration laws have serious national security and public safety implications- and this is something that is blithely ignored by  everyone who has advocated for Comprehensive Immigration Reform- the folks I have come to refer to as the “Immigration Anarchists!”
One of the ringleaders of this effort is none other than New York City’s Mayor Bloomberg- the city that suffered the brunt of the terrorist attack of September 11, 2001!
It is insane that politicians such as Bloomberg are able to grasp the concept that a gun in the hands of someone who is mentally ill or has a criminal history poses a threat to public safety but cannot or, more likely, will not accept the fact that aliens who evade the inspections process that was created to screen aliens seeking to enter the United States who would pose a threat to the safety and well being of America and Americans must also be considered a threat to public safety!
When I testified before the Senate Judiciary Committee at a hearing conducted last week, on March 20, 2013, I quoted two important excerpts from the 9/11 Commission Staff Report on Terrorist Travel:

First of all, here is the first paragraph from the preface of that report:

“It is perhaps obvious to state that terrorists cannot plan and carry out attacks in the United States if they are unable to enter the country. Yet prior to September 11, while there were efforts to enhance border security, no agency of the U.S. government thought of border security as a tool in the counterterrorism arsenal. Indeed, even after 19 hijackers demonstrated the relative ease of obtaining a U.S. visa and gaining admission into the United States, border security still is not considered a cornerstone of national security policy. We believe, for reasons we discuss in the following pages, that it must be made one.”

Here is a paragraph under the title “Immigration Benefits” found on page 98:

“Terrorists in the 1990s, as well as the September 11 hijackers, needed to find a way to stay in or embed themselves in the United States if their operational plans were to come to fruition. As already discussed, this could be accomplished legally by marrying an American citizen, achieving temporary worker status, or applying for asylum after entering. In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.”

Clearly the 9/11 Commission staff did an excellent job of “connecting the dots” where the nexus between national security and immigration law enforcement is concerned, yet Bloomberg and his ilk refuse to take the advice and findings of the 9/11 Commission into account.
The murder of children in Connecticut and other crimes that involving firearms have, according to news reports, spurred Bloomberg to spend $12 million of his own money to create an ad campaign to call for background checks for those who purchase firearms, yet the presence of millions of illegal aliens for whom meaningful background checks cannot be easily accomplished does not phase him!
Wow!
This represents a monumental disconnect from reality!
Chicago has one of the highest murder rates in the United States and arguably the toughest gun laws.  Gangs are the problem in Chicago.  Yet Bloomberg and many of his fellow politicians refuse to accept the truth!
While we are on the topic of violence in Chicago, here is a quote worth considering:
Daily turf battles over drugs and distribution, he said, are turning parts of this Midwest city into a Mexican border town.”
That alarming quote was made by no less an authority than Jack Riley, the current Special Agent-in-Charge (SAC) of DEA’s Chicago field office when he was interviewed for a news report that aired on the CBS Evening News with Scott Pelley, on August 23, 2012.
Lest you think that Riley does not know what he as talking about, you should know that his previous job was to head up the DEA’s

field office in El Paso, Texas.  You may recall that El Paso is situated directly north of Ciudad Juarez- arguably Mexico’s most violent city!  


I wrote an article for the CAPS website that I gave the title:
When I was the INS representative to the Unified Intelligence Division of the DEA in New York City in 1988 (I was the first INS agent to be given that assignment), I decided to do an analysis of the arrest statistics to determine who was being arrested by the DEA in New York as well as across the United States.  It was eye-opening to discover that in New York City some 60% of those arrested by the DEA and the DEA Task Force were identified as being “Foreign born” while nationally some 30% of those arrested were so identified.
Today even the DHS, an agency I have sarcastically come to refer to as the Department of Homeland Surrender concedes that hundreds of U.S. cities are infested by members of the extremely violent Mexican drug cartels while even more cities are also infested by other transnational gangs.

Here is a quote from my commentary and a link to a video of a news conference conducted by Congressmen Steve King and Walter Jones  (I was gratified that Congressman King took the opportunity of this news conference to quote me when I testified before a House Immigration Subcommittee hearing:
On Thursday, November 3rd of this year Representative King, Representative Walter B. Jones and members of the Tea Party Immigration Coalition, the Federal Immigration Reform and Enforcement (FIRE) Coalition and the Foreign National Crime Information Center which administers a website that tracks homicides committed by illegal aliens on the Victims of Illegal Alien Crime Memorial, held a news conference in Washington, D.C., to discuss the issue of innocent lives lost to the failures of our nation to effectively enforce and administer our nation’s immigration laws.  Below I have attached a copy of a letter to President Obama from the leaders of the Tea Party Immigration Coalition and the Federal Immigration Reform Enforcement Coalition asking that this November 6th and from now on, every November 6th be declared a “Day of Remembrance for the Victims of Illegal Aliens.”

According to Representative King, every year, seven thousand people are killed in the United States by illegal aliens.  Yet Mayor Bloomberg continues to not simply turn a blind eye to this but has done everything in his power to encourage still more illegal aliens to enter the United States in violation of law and head for the “Big Apple” knowing that New York’s sanctuary policies will shield them from detection by the federal government.  (Of course the federal government has all but created a “Sanctuary Country” by not enforcing our immigration laws, laws that were enacted to protect innocent lives and the jobs of American workers.
I have also written about how such sanctuary policies ultimately resulted in the death of New York City Police Officer Robert Machate.
One of my video interviews for TalkBorder.com was conducted with Officer Robert Matchate’s brother, Thomas Machate who is, now, himself, a retired NYC police officer.  

The focal point for our conversation was, as you might expect, the murder of Robert Machate on March 3, 1989.  On that tragic day, Police Officer Robert Machate was involved in an encounter with an illegal alien from Panama, Reynaldo Rayside on the streets of Brooklyn, New York.  Rayside grabbed for Officer Machate’s service weapon and shots rang out.  When it was over, Police Officer Machate was dead.  He was just 24 years old and his wife was pregnant with a daughter he would never see or hold.

A couple of years before that tragedy played out in a Brooklyn neighborhood, I had been assigned to execute a Warrant of Deportation issued by an Immigration Judge against Rayside.  Rayside had been granted lawful immigrant status and was issued an Alien Registration Receipt Card also known as a “Green Card” to signify the fact that he was a lawful immigrant who had been placed on the pathway to United States citizenship.  He had been handed an opportunity that so many people would desperately want to have and then he blew it!  He was subsequently convicted of committing felonies which resulted in his being ordered deported from the United States.

Incredibly Rayside had been arrested by members of the NYPD on two separate occasions after he was deported from the United States and unlawfully reentered the United States.  He was not only illegally present in our country at that time but was apparently guilty of a felony- unlawfully reentering the United States after having been deported.  Yet the NYPD apparently never notified the INS about Rayside being encountered and arrested by members of that police department.  Had the INS (Immigration and Naturalization Service) taken him into custody and prosecuted him for unlawful re-entry, Rayside would not have been at large on that fateful day that Officer Machate died.  Illegal immigration is not a “victimless crime!”

Because of my involvement with Rayside, I was called upon to provide testimony at the murder trial at which he stood accused of murdering Police Officer Machate.  It was at that trial that I first met Tom Machate and his family.

While many newspaper accounts and television news programs are focused on how illegal aliens suffer we almost never hear about how Americans suffer because of crimes committed by illegal aliens.  Many times newspaper accounts don’t even address the fact that a criminal who was arrested for a heinous crime was, in fact, an illegal alien.
Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!The immigration laws are supposed to achieve two primary goals- to protect American lives and protect Americans’ jobs.  

Our nation is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda or other terrorist organizations!

It is also vital that American workers never be made to compete with foreign workers for their jobs!  (This requirement is a component of the Immigration Laws that are not being enforced today!)

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws that are intended to protect our nation and our citizens concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

I also ask that you pass this e-mail along to your friends and neighbors- I am attempting to create a “Bucket Brigade of Truth!”

We the People must make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

michael_cutler  On September 27, 2012 the New York Post published an article, “Bloomberg blasts Bronx DA for not prosecuting trespassing arrests” which stated:

     “Mayor Bloomberg blasted the Bronx DA’s controversial policy of not prosecuting some trespassing arrests in public housing — saying that the move will bring the city back to its bad old days of crime and disorder.”

I wrote a commentary for CAPS about that article comparing those who would trespass into public housing buildings with aliens who trespass into the United States- drawing the obvious analogy.

Now “Crusader Mayor” Bloomberg is adamant about mandating background checks for those who purchase firearms, but apparently couldn’t care less about the identities and backgrounds of millions of illegal aliens.

On March 24, 2013 Bloomberg Businessweek, ran a story headlined:

Mayor Bloomberg Unveils $12 Million Ad Campaign for Gun Checks

Bloomberg’s concern, and one I share, is that it is important to be sure that those who would purchase firearms aren’t convicted felons or  mentally ill. Certainly it’s a bad idea to have criminals or the unstable given access to guns.

However, when aliens enter the United States by evading the inspections process, no record of their entry is created. There’s  no way to know anything about their backgrounds:  Not their names, their dates of birth, their criminal histories or even their actual birth countries or  true citizenship.

The inspections process conducted at ports of entry is designed to prevent the entry of aliens whose presence would be detrimental to the United States and its citizens.  Title 8, United States Code, Section 1182 enumerates the categories of aliens who are to be excluded.  Among these classes are aliens who suffer from dangerous communicable diseases or extreme mental illness. Additionally convicted felons, human rights violators, war criminals, terrorists and spies are excluded as well as aliens who would seek unlawful employment or become public charges.

Aliens who circumvent the inspections process belong to one or more classes of inadmissible aliens. Yet Bloomberg’s sanctuary policies prohibit the NYPD from notifying ICE when a suspected illegal alien is encountered during the course of routine police work. Sanctuary policies shield illegal aliens whose true identities, backgrounds and intentions are unknown and unknowable.  As the saying goes, “You cannot tell a good guy from a bad guy without a scorecard.”

“Undocumented” aliens have no scorecards!

Incredibly while Bloomberg is nervous about who gets to carry a gun, he’s not nervous about the  identities and intentions of  hundreds of thousands of illegal aliens who live and work in the “Big Apple!”

There’s a saying that “Guns don’t kill people but people kill people.”  Guns are involved in crimes but so are knives and other  weapons.  Auto accidents kill far more people than firearms, yet Bloomberg apparently does not care if illegal aliens are able to drive on New York’s roads.  NYPD officers are ordered to not take immigration status into account when stopping a motorist or making an arrest.

Consider this quote from the preface of the  9/11 Commission Staff Report on Terrorist Travel

     “It is perhaps obvious to state that terrorists cannot plan and carry out attacks in the United States if they are unable to enter the country….We believe, for reasons we discuss in the following pages, that it (border security ) must be made one.”

Bloomberg and all of our elected officials should be at least as concerned about the aliens present in the United States as they are about the identities of those who would purchase firearms.
