Earlier today, Saturday, May 7th, I appeared on Fox & Friends to debate the issue of San Francisco’s wrong-headed decision to not notify ICE (Immigration and Customs Enforcement when they have an illegal alien in custody they arrested pursuant to non-immigration violation(s) of law as required by the program known as “Secure Communities.”

At the risk of being repetitive, here is what I noted when I sent out my notice that I would be appearing on Fox & Friends to debate this issue, starting with a link to the infomration contained on the ICE website concerning “Secure Communities:”
San Francisco has an established track record of minimizing the importance of the immigration laws of our nation and, in so doing, not only imperil the residents of their city but the residents of our nation. It is important to realize that the immigration laws are utterly blind as to race, religion and ethnicity and are designed to attempt to prevent the entry of aliens into our country whose presence is harmful or potentially even dangerous to our nation and our citizens and others who are present in our country. As I have often n oted, the immigration laws of the United States establish categories of aliens who are to be excluded from our country and who should be removed from our country if they manage to enter the United States.
If you doubt what the laws about the exclusion of aliens are about, here is a link to Title 8 of the United States Code, Section 212- these are the grounds under which an alien would be ineligible to be lawfully admitted into the United States:
Our nation was first attacked by alien terrorists in 1993 who managed to game the visa issuing process and the immigration benefits program to enter our country and embed themselves in our country in order to carry our their deadly missions.
On September 11, 2001 our nation was again attacked by foreign nationals (aliens) who secured visas through fraud and were able to embed themselves by committing immigration benefit fraud. Several of the terrorists were out of status prior to the attacks of September 11 and had been contacted by local law enforcement pursuant to routine police work- stops for motor vehicle law violations but were permitted to go on their way. Had they been arrested and handed over to the former INS it is entirely possible that the attacks of 9/11 would have been averted.
In the wake of the death of Osama Bin Laden we have been told that we must be vigilant and that al-Qaeda operatives will likely attempt to take reprisals. Our nation currently has unknown tens of millions of illegal aliens in our country whose true identities, backgrounds, possible involvement in criminal or terrorist organizations is unknown and it is important, for a host of reasons, to discourage illegal immigration.
In fact, if individuals encourage or aid or abet aliens to violate our immigration laws or our supposedly “sovereign” borders, they are committing a felony. Of course given the posture of this administration there is no danger that anyone in San Francisco would be charged with committing a crime while the State of Arizona is being sued by the United States Department of Justice for daring to confront the outrageous level of kidnappings and home invasions mostly at the hands of members of the drug cartels carry out an average of one such attack each and every day in Phoenix!
Here is an excerpt of the relevant section of the immigration laws that deem the encouragement of aliens to violate our borders and our laws is a felony under the United States Code:
Title 8, U.S.C. § 1324(a) defines several distinct offenses related to aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic transportation of unauthorized aliens, concealing or harboring unauthorized aliens, encouraging or inducing unauthorized aliens to enter the United States, and engaging in a conspiracy or aiding and abetting any of the preceding acts. Subsection 1324(a)(2) prohibits bringing or attempting to bring unauthorized aliens to the United States in any manner whatsoever, even at a designated port of entry. Subsection 1324(a)(3).
Encouraging/Inducing — Subsection 1324(a)(1)(A)(iv) makes it an offense for any person who — encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law.
Conspiracy/Aiding or Abetting — Subsection 1324(a)(1)(A)(v) expressly makes it an offense to engage in a conspiracy to commit or aid or abet the commission of the foregoing offenses.

Furthermore, local law enforcement often arrests individuals who are wanted by other local or state or federal law enforcement agencies. By not cooperating with ICE San Francisco is thwarting efforts to enforce the immigration laws that are supposed to protect our nation and our citizens and it is inexcusable!

My goal in writing this and other commentaries is to point out our nations many failings before more victims pay the ultimate price for the incompetence and ineptitude of our government.
The first step in problem-solving is to first identify the problems and vulnerabilities and then devise strategies to overcome them.

The practice of good citizenship does not end in the voting booth, it only begins there.
The large scale apathy demonstrated by citizens of this nation has emboldened elected representatives to all but ignore the needs of the average American citizen in a quest for massive campaign funds and the promises of votes to be ostensibly delivered by special interest groups. There is much that we cannot do but there is one thing that We the People absolutely must do- we must stop sitting on the sidelines!
The collective failure of We the People to get involved in make our concerns known to our politicians have nearly made the concerns of the great majority of the citizens of this nation all but irrelevant to the politicians. I implore you to resolve this year to get involved!
I believe our nation’s is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world. However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda!
If this situation concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation!
All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!
We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.
This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!
You are either part of the solution or you are a part of the problem!
Democracy is not a spectator sport!
