"International partnerships are key to fighting transnational crime"

My most recent article for the CAPS (Californians for Population Stabilization) website is attached below and serves as the predication for my commentary today.

Whenever we deal with others we are concerned with their motivations for the things they do and say (or fail to do or refuse to speak about).

How many times have we heard the following questions asked of a witness at a trial or, perhaps, a Congressional hearing, “What did you know and when did you know it?”  
The problem is that truth is often hard, if not impossible to come by.  Polygraph machines and their operators are often employed by companies and government agencies that are concerned about the honesty of employees and others.

Today we will try to gain a bit of insight into the motivations of our government insofar as purported efforts to protect our nation and our citizens from international terrorists and transnational criminals are concerned.  My method will be to analyze a recent news release that was issued by ICE (Immigration and Customs Enforcement) touting the values of international cooperation with foreign governments and the ways that this cooperation can translate into enhanced security for the United States.

Interestingly cooperation between the United States and the government of Israel was highlighted in the ICE news release.  I had the distinct privilege of working closely with the Israeli National Police (INP) for nearly my entire career as an INS special agent as a result of a threat to an Israeli oil refinery posed by a terrorist plot that I stumbled upon in 1976.  Both the United States and Israel benefited greatly from the various instances where we worked cooperatively following that fortuitous discovery which enabled the Israeli’s to thwart that attack in 1976.

The issue that provides insight into the understanding of our government has of the value of the visa requirement, however, will not provide you with comfort.  Clearly the author of the ICE news release understands just how important the visa process is to national security and yet, the administration continues to push to increase the number of countries that participate in the Visa Waiver Program in a particularly dangerous era.  Currently the citizens of 36 countries do not need to apply for visas before seeking to enter the United States as tourists.

The ICE news release highlighted the importance of uncovering fraud in applications for visas, yet under the auspices of the Visa Waiver Program, no applications are filed and so it is impossible to seek to uncover fraud!  This is just one of several reasons why the Visa Waiver Program is wrong-headed and, indeed, dangerous to our nation and our citizens.

The conclusion that must be reached is that the administration understands how the Visa Waiver Program undermines national security and eliminates what should be a critical layer of security- it simply has decided that placating the Chamber of Commerce and other members of the Discover America Partnership that likely make huge campaign contributions, trumps national security!

Show me a politician who refuses to enforce the immigration laws or attempts to trivialize these laws, and I will show you a politician who needs to find out what it is like to stand on the unemployment line!

Benjamin Franklin, in discussing our then fledgeling nation, said that they had given us a republic if we could keep it!


What he was making clear was that this democratic republic required that its citizens take their citizenship seriously and keep the political leaders accountable.

It is time for the citizens of our nation to make certain that our nation’s leaders, on all levels, to come to terms with the fundamental fact that the purpose of our immigration laws is to protect our nation and our citizens from aliens whose presence has the potential to have a serious adverse impact.  Ignoring those laws exposes our nation and our citizens to a variety of serious threats and challenges ranging from national security and criminal justice and public safety to the economy, the environment, healthcare and education!

A country without secure borders can no more stand than can a house without walls!

I

our country is to survive and if our children and their children are to get their share of the “American Dream” the citizens of this nation must take their citizenship seriously!

We the People must be the best citizens we can be, citizens who are worthy of the gallantry demonstrated by our valiant men and women in the military, law enforcement and firefighters, who routinely go in harm’s way in defense of this nation and our citizens.  
My goal in writing this and other commentaries is to point out our nations many failings before more victims pay the ultimate price for the incompetence and ineptitude of our government.
The first step in problem-solving is to first identify the problems and vulnerabilities and then devise strategies to overcome them.

If you find yourself to be in agreement with this commentary, I ask that you forward it to as many of your friends and family members as possible and encourage them to do the same.  We need to create a “Bucket Brigade of Truth!”

The practice of good citizenship does not end in the voting booth, it only begins there.

For far too long our citizens demonstrated apathy which emboldened elected representatives to all but ignore the needs of the average American citizen in a quest for massive campaign funds and the promises of votes to be ostensibly delivered by special interest groups. 

I am encouraged that more and more of us, We the People, are not willing to simply sit on the sidelines anymore!


I believe our nation’s is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda!

I also believe that the original purpose of our nation’s immigration laws need to be be brought “front and center” to make certain that our nation does not permit the entry of aliens into our country whose presence in our country is problematic for the citizens of our nation and that if such aliens do succeed in entering our country that our nation have the resources, integrity and dedication to do everything possible to make it impossible for such aliens to function within our country so that even if they are not apprehended, they will find it pointless to remain in the United States.
As I have noted on a number of occasions, “No one would break into the amusement park if they could not get to go on the rides and no one remains in the amusement park at the end of the day when they turn shut down the rides and turn off the lights!” 

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

International partnerships are key to fighting transnational crime

An ICE (Immigration and Customs Enforcement) news release
dated March 20, 2012 reported on the importance of the close working
relationship that has been established between personnel of the HSI
(Homeland Security Investigations) division of ICE, with law enforcement
authorities of both the government of Israel and representatives of the
Palestinian Authority.

Here is an excerpt from the recent ICE news release:

As part of their duties overseas, HSI special agents
often examine visa applications for fraud, initiate investigations,
coordinate with law enforcement partners and provide training and advice
to Department of State consular officers. The work performed by these
special agents is vital to protecting the United States against
terrorist and criminal organizations.

As is all too often the case, while news releases issued by the
administration provide flowery statements that accurately explain
effective strategies on the one hand, the administration takes actions
and adopts policies that are diametrically opposed to the very same
strategies that are touted in the news releases.

The fact is that fraud is a huge factor throughout the
entire immigration system and the process by which visas are issued must
be considered an integral component of the immigration system. Although
it is up to the consular officials of the State Department to determine
whether or not to issue a visa to an alien in the first place, the
authority to admit an alien who has a visa is the domain of the
inspectors of CBP (Customs and Border Protection).  In a manner of
speaking, the visa requirement pushes our nation’s border to the United
States Embassy or Consulate where visas are issued.

However, while the news release correctly addresses the importance of
combating fraud in the visa process, under the Visa Waiver Program, the
United States currently permits aliens from some 36 countries to enter
the United States for up to 90 days without first applying for and
receiving a visa – a process that adds an important layer of security
for our nation.

“Visa Waiver Program Endangers our Safety and Security,”
a recent commentary on CAPS’ website, provided a list of six ways in
which the visa process can be helpful to law enforcement and prevent the
entry of aliens whose presence in our country may prove harmful to our
nation and our citizens.  (Under the Visa Waiver Program, not one of
these important benefits applies.)

The Visa Waiver Program runs contrary to the recommendations of the
9/11 Commission which cited flaws in the system resulting in visas being
issued to the terrorists.  If laxity in the visa issuing process
enabled the terrorists to enter the United States, why would we now
permit citizens of 36 countries to enter our country in this day and age
without first obtaining any visa at all?  Incomprehensibly, the
President has made it clear that he intends to seek to expand the Visa
Waiver Program to include even more countries – this at a time when
American citizens, including the elderly and young children, can expect
to experience ever more intrusive searches if they seek to board
airliners in the United States!

Consider this:  There are more than 60,000 employees at the TSA
(Transportation Safety Administration), many of whom are engaged in
searching airline passengers, but there are only about 7,000 ICE special
agents for the entire United States of America and fewer than half of
them are engaged in investigating violations of customs laws and not
immigration laws.  In fact, many of the key managers of ICE and CBP came
from Legacy Customs and not from the former INS (Immigration and
Naturalization Service).  There are reportedly fewer than 300 ICE
enforcement personnel searching for a population of visa violators that
is estimated to be in excess of 5 million!

These numbers just don’t add up, nor do the decisions made by our
government’s leaders, where nothing less than national security is at
stake!
