â??Waivingâ?? Goodbye to Checks and Balances

Hi Gang:

My most recent article that appears on the CAPS (Californians for Population Stabilization) website serves as my predication for my commentary today.

The continuing effort to encourage and induce as many aliens as possible to enter the United States so that they can be exploited by a long list of individuals and organizations is rapidly eroding national security, community safety and, in fact, the very institutions that comprise our government!  The administration has taken to the worrying tactic of issuing policy directives to the enforcement personnel of ICE and CBP to ignore laws that are supposed to be enforced, to satisfy a political agenda.  Those immigration laws are a vital component of national security and are also essential to the well being of our nation and our citizens.

Simply stated, our immigration laws are designed to protect American lives and American jobs.  The immigration laws are utterly and completely blind as to race, religion and ethnicity. 

Because of the ongoing efforts by the administration, aided and abetted by politicians from both major political parties on the national level as well as on the state and local level in some areas of our country, the enforcement of  immigration laws has been vilified and blocked by the creation of so-called “Sanctuary Cities.”  Under Title 8, United States Code, Section 1324, a section of law that s contained within the Immigration and Nationality Act (INA), it is a felony to aid, abet, encourage or induce aliens to enter our country illegally or remain in our country illegally.

Consider this excerpt from that section of law:

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;

(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law…

When local or state government or law enforcement officials openly boast that they will not challenge the identity of a suspect of a crime to attempt to determine if such individuals are citizens, lawful immigrants or illegal aliens, they are in effect taking actions that are contrary to the immigration laws and such actions constitute felonies.  Yet the administration will take no action against them but will pursue lawsuits against those states, such as Arizona and Alabama that have, out of frustration, enacted their own immigration laws that essentially parallel the federal immigration laws in an effort to protect the lives of the citizens and others who live within their jurisdiction against the violence being perpetrated by members of transnational gangs. 

On November 10, 2011 I wrote an article for CAPS that was entitled, “Victims
of Illegal Immigration”
 that delved into the outrageous loss of life as a result of crimes committed by illegal aliens who should not have been present in the United States in the first place.

With all of the talk about the need to create jobs, there are precious few politicians willing to advocate for the liberation of jobs by calling for the enforcement of our immigration laws to remove illegal aliens from the workforce to enable American workers of all races, religions and ethnicities to take those jobs!
Show me a politician who refuses to enforce the immigration laws or attempts to trivialize these laws, and I will show you a politician who needs to find out what it is like to stand on the unemployment line!

Benjamin Franklin, in discussing our then fledgeling nation, said that they had given us a republic if we could keep it!


What he was making clear was that this democratic republic required that its citizens take their citizenship seriously and keep the political leaders accountable.

It is time for the citizens of our nation to make certain that our nation’s leaders, on all levels, to come to terms with the fundamental fact that the purpose of our immigration laws is to protect our nation and our citizens from aliens whose presence has the potential to have a serious adverse impact.  Ignoring those laws exposes our nation and our citizens to a variety of serious threats and challenges ranging from national security and criminal justice and public safety to the economy, the environment, healthcare and education!

A country without secure borders can no more stand than can a house without walls!

I

our country is to survive and if our children and their children are to get their share of the “American Dream” the citizens of this nation must take their citizenship seriously!

We the People must be the best citizens we can be, citizens who are worthy of the gallantry demonstrated by our valiant men and women in the military, law enforcement and firefighters, who routinely go in harm’s way in defense of this nation and our citizens.  
My goal in writing this and other commentaries is to point out our nations many failings before more victims pay the ultimate price for the incompetence and ineptitude of our government.
The first step in problem-solving is to first identify the problems and vulnerabilities and then devise strategies to overcome them.

If you find yourself to be in agreement with this commentary, I ask that you forward it to as many of your friends and family members as possible and encourage them to do the same.  We need to create a “Bucket Brigade of Truth!”

The practice of good citizenship does not end in the voting booth, it only begins there.

For far too long our citizens demonstrated apathy which emboldened elected representatives to all but ignore the needs of the average American citizen in a quest for massive campaign funds and the promises of votes to be ostensibly delivered by special interest groups. 

I am encouraged that more and more of us, We the People, are not willing to simply sit on the sidelines anymore!


I believe our nation’s is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda!

I also believe that the original purpose of our nation’s immigration laws need to be be brought “front and center” to make certain that our nation does not permit the entry of aliens into our country whose presence in our country is problematic for the citizens of our nation and that if such aliens do succeed in entering our country that our nation have the resources, integrity and dedication to do everything possible to make it impossible for such aliens to function within our country so that even if they are not apprehended, they will find it pointless to remain in the United States.
As I have noted on a number of occasions, “No one would break into the amusement park if they could not get to go on the rides and no one remains in the amusement park at the end of the day when they turn shut down the rides and turn off the lights!” 

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

“Waiving” Goodbye to Checks and Balances

Just
when you think you’ve seen it all, the Obama administration has found
yet another way to outdo itself where immigration policies are
concerned. The newest ploy: an outrageous proposal to provide illegal
aliens with “An Unlawful Presence Waiver.”

This newest assault on the rule of law (reported
by Fox News on April 2) would give illegal aliens permission to remain
in the U.S. if they can prove they have at least one U.S. citizen family
member.

In order to deal with the onslaught of applications the already
beleaguered adjudications officers of USCIS (United States Citizenship
and Immigration Services) would find even more work to accomplish within
tight time constraints and scarce resources.  USCIS currently has only
about 700 immigration investigators looking into suspected fraud and
adjudicates some 7 million applications every year.  As a result, it is
highly likely that, as is the case with nearly every immigration benefit
program, fraud will permeate the system.  As a consequence a
significant number of illegal aliens would suddenly be made “legal.”

It must also be presumed that these aliens will be granted employment
authorization and documentation to legally work in the U.S. While the
regulations do not mention this specifically, the Obama administration
has already issued policy directives to terminate some 300,000 cases
already under deportation proceedings and provide them with employment
authorization. The supposed reasoning is that if an alien is allowed to
remain in the U.S. for an extended period of time then they should be
able to work and support themselves.  It would therefore logically
follow that aliens whose waivers are approved would similarly be granted
employment authorization.

The news is full of stories about jobs that have been created and
unemployment statistics looking up, but they all fail to include the
millions of American workers who have fallen off the radar and are no
longer included in those unemployment statistics.  The Administration is
working overtime to overwhelm unemployed American workers by dumping
God knows how many thousands or potentially millions of “legalized”
aliens into the job market.

Furthermore, because these aliens evaded the inspections process, it
must be presumed that they belong to one or more categories of aliens
who are by law excludable from entering the U.S. This is a terrible risk to national security and community safety.

Finally, this program sends an invitation tied with a big red bow:
Come to America! Violate our nation’s borders and our laws! Not only
will you not be arrested and deported, you will be rewarded for your
transgressions!

We have seen a succession of Democrat and Republican administrations
ignore the will of the people and the immigration laws to enable a
continuing flood of illegal aliens from countries across the planet
where their impact is felt in nearly every challenge and threat that
confronts our nation today. This is why there are now unknown millions,
perhaps tens of millions, of illegal aliens now living in towns and
cities across our vast country.

By words and deeds, the Obama administration is convincing foreign
nationals that America’s borders and immigration laws are mere
formalities that are easy to overcome.

Even more frightening in its implication, this program and the
Administration, is thumbing its nose at the vital foundation of checks
and balances which our Founding Fathers devised to prevent a tyrant from
taking control over our government. The purpose of our three branches
of government (Executive, Legislative and Judicial) is to limit the
power of our government and prevent a “power grab” by those who are
elected to lead our nation. Lord Acton famously stated, “Power tends to
corrupt, and absolute power corrupts absolutely.”

By making a mockery of our laws and the democratic process, this
administration has taken to a new and disturbing tact – waiving laws
that have been protecting American lives and jobs for decades to
apparently seek a political advantage at the expense of our nation and
our citizens.
