"Criminal Alien Fugitive Arrested Working in the United States"

Hi Gang:

I am providing you, below, with my most recent commentary for the CAPS (Californians for Population Stabilization) website.

I would urge you to read the press release that was posted by ICE (Immigration and Customs Enforcement) on its website upon which my commentary is based- the link to that press release is contained in the CAPS.

When you consider how Cesar “El Chilin” Vega-Muñoz, an extremely dangerous illegal alien, managed to hide in plain sight by working in a nondescript job as a cook in a small restaurant, you have to come to the understanding that illegal immigration and worksite enforcement can serve two important missions- to prevent the employment of illegal aliens to free up jobs Americans and lawful immigrants desperately need, especially in these challenging days where it is estimated that one in four American children are “food insecure” meaning that they wake up each day not knowing if they will have three meals to eat, and to remove the foliage that aliens with criminal backgrounds or terrorist backgrounds hide in.  

During the previous administration, President George W. Bush used to promote his Guest Worker (Amnesty) program by saying that if the United States would simply allow hard working aliens to enter the United States to work in the United States doing the work American would not do that law enforcement could concentrate on going after the criminals and terrorists.  Of course where the “work Americans won’t do” is concerned, the issue was never that the work was too difficult but that the wages and working conditions were well below what Americans would be willing to tolerate.  Illegal aliens are so desperate to work in the United States and send money back to their families in their home countries that they minimize their expenses in the United States by sharing a small, cramped apartment with a dozen or more compatriots and avoid spending money on anything other than absolute bare minimum necessities.

Aliens who are involved with criminal activities and criminal activities are generally able to hide in plain sight or, in the words of the 9/11 Commission, embed themselves in communities around the United States by taking nondescript jobs that often provide them with mobility as well as camouflage.

As an  INS special agent I can tell you of many instances where I had arrested individuals who were wanted for serious crimes, who were engaged in activities supportive of terrorism.   One case in particular comes to mind.  During the course of conducting an investigation into possible illegal aliens working in a glass factory where the workers were on strike and the employer hired new employees.  As my colleagues and I went around the factory interviewing the employees who were working at the factory, I encountered an employee who initially claimed to be a United States citizen who had naturalized.  As I recall he had been born in Belize (British Honduras).  I jotted down his name, date of birth and other relevant information and asked him a few questions about the process by which he had acquired United States citizenship.  His answers left me concerned that he was likely lying about the way he had naturalized and so I contacted my office to attempt to locate his immigration file to determine if he had, in fact, become a naturalized citizen.  I was informed that there was no record of this guy in the system.  Clearly something was amiss.  A naturalized citizen would most certainly have an immigration file that would contain the record of his initial entry into the United States and the paperwork associated with his application for naturalization as well as a copy of his Naturalization Certificate and relating documentation.  We went back to to make certain that he had provided us with all of the proper information and it became apparent that he was not telling the truth, where upon we arrested him on the suspicion that he was an illegal alien.  As it turned out, he had provided us with a false name and was, in fact an alien who had been previously convicted of manslaughter through a plea bargain arrangement and had served time for that crime.  

Upon the completion of his prison sentence he had been deported and then unlawfully re-entered the United States illegally without permission.  He was convicted for unlawful re-entry and while serving his sentence upon conviction for that crime, he escaped from a federal prison and I stumbled upon him as he worked in that glass factory in Brooklyn!  The point is that all too often criminals and terrorists hide in plain sight by taking mundane jobs. 

With growing concerns about workplace violence, it should be apparent that employers must do the most diligent job that they can to properly identify their employees to not only make certain that comply with our nation’s immigration laws but to also make certain that they don’t employ those who might pose serious threat to the safety and well being of fellow employees and others that these employees come into contact with. 

I have often noted that when aliens violate our immigration laws there is no way of truly knowing all of the motivations that they had in running our nation’s borders.  Certainly most illegal aliens seek unlawful employment in the United States, but in addition, we must consider the various provisions of the Immigration and Nationality Act (INA) that deem various categories of illegal aliens to be excludible from the United States.

Title 8, United States Code section 212 is section of law that enumerates the various categories of aliens who, under the Immigration and Nationality Act, are supposed to be prevented from entering the United States and are supposed to be removed if they are found here:


Please take the time to review the contents of this section of the Immigration and Nationality Act (INA).

Among the categories of aliens who are supposed to be kept out of the United States are aliens with dangerous communicable diseases, aliens who suffer serious mental illness and are prone to violence, aliens who are convicted felons, aliens who fugitives from justice in other countries, aliens who are human traffickers and drug smugglers, aliens who are war criminals and aliens who have committed human rights violations.  Also aliens who are engaged in terrorism and espionage are among those who are, by law, supposed to be prevented from entering our country and are supposed to be removed if they manage to evade the Border Patrol and enter the United States.

Our nation’s immigration laws are intended to protect American lives and American jobs.  Aliens who violate those laws and the system that should be operating effectively to enforce those laws create a grave risk to the lives and well being of our citizens, our lawful immigrants and our nation.

This is not a complex concept- this is commonsense!  But then who actually expects our politicians to demonstrate commonsense our decency?  The frustration that most Americans feel about Congress and politicians can, no doubt, be traced to the insane idea that it is “Pro-Immigrant” to reward illegal immigration!

Why should anyone abide by the law when our government wants to reward millions of law violators who may well pose a threat to the safety and well being to our nation and our citizens?
Show me a politician who refuses to enforce the immigration laws or attempts to trivialize these laws, and I will show you a politician who needs to find out what it is like to stand on the unemployment line!

Benjamin Franklin, in discussing our then fledgeling nation. said that they had given us a republic if we could keep it!


What he was making clear was that this democratic republic required that its citizens take their citizenship seriously and keep the political leaders accountable.

It is time for the citizens of our nation to make certain that our nation’s leaders, on all levels, to come to terms with the fundamental fact that the purpose of our immigration laws is to protect our nation and our citizens from aliens whose presence has the potential to have a serious adverse impact.  Ignoring those laws exposes our nation and our citizens to a variety of serious threats and challenges ranging from national security and criminal justice and public safety to the economy, the environment, healthcare and education!

A country without secure borders can no more stand than can a house without walls!

I

our country is to survive and if our children and their children are to get their share of the “American Dream” the citizens of this nation must take their citizenship seriously!

We the People must be the best citizens we can be, citizens who are worthy of the gallantry demonstrated by our valiant men and women in the military, law enforcement and firefighters, who routinely go in harm’s way in defense of this nation and our citizens.  
My goal in writing this and other commentaries is to point out our nations many failings before more victims pay the ultimate price for the incompetence and ineptitude of our government.
The first step in problem-solving is to first identify the problems and vulnerabilities and then devise strategies to overcome them.

The practice of good citizenship does not end in the voting booth, it only begins there.

For far too long our citizens demonstrated apathy which emboldened elected representatives to all but ignore the needs of the average American citizen in a quest for massive campaign funds and the promises of votes to be ostensibly delivered by special interest groups. 

It is therefore understandable that the politicians of both parties, are greatly concerned about the demonstrations currently sweeping our nation just as did the creation of the Tea Party.  Clearly  more and more of our fellow Americans are demonstrating that they are not as dumb as the politicians from both parties had expected us to be!

I am encouraged that more and more of us, We the People, are not willing to simply sit on the sidelines anymore!


I believe our nation’s is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda!

I also believe that the original purpose of our nation’s immigration laws need to be be brought “front and center” to make certain that our nation does not permit the entry of aliens into our country whose presence in our country is problematic for the citizens of our nation and that if such aliens do succeed in entering our country that our nation have the resources, integrity and dedication to do everything possible to make it impossible for such aliens to function within our country so that even if they are not apprehended, they will find it pointless to remain in the United States.
As I have noted on a number of occasions, “No one would break into the amusement park if they could not get to go on the rides and no one remains in the amusement park at the end of the day when they turn shut down the rides and turn off the lights!” 

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Criminal Alien Fugitive Arrested Working in the United States

There
is a mythology that the open borders anarchists love to perpetuate;
aliens who run our borders are simply trying to make some money doing
the work Americans won’t do.

I just love being a “Myth Buster!”

My commentary today is predicated upon a news release that appeared
on the ICE (Immigration and Customs Enforcement) website on January 9.
2012 and was titled: ICE HSI agents arrest fugitive, member of Juarez kidnapping ring Cesar ‘El Chilin’ Vega-Muñoz was working at local restaurant.

The point is that, contrary to what many politicians and high ranking
members of the Obama administration may claim, it most certainly is a
serious matter when an alien violates our nation’s borders and the
inspections program that is supposed to prevent the entry of aliens into
our country who pose a threat to the wellbeing and safety of our nation
and our citizens.

Our military is increasingly relying on stealth technology to conceal
its weapons from the enemies from the United States.  Think of how much
money has been spent on all sorts of technology to make our aircraft
invisible to radar.  New naval vessels are now also being constructed to
reduce their radar cross section to make them harder to detect.

For quite some time soldiers have worn camouflage fatigues and even
have applied a sort of grease-paint makeup to achieve the goal of
concealment to make them less visible to their enemies while their
enemies utilize similar tactics for the same purpose.

Homeowners are advised to trim shrubs around doors and windows and
install motion sensors that turn on bright lights when someone
approaches their homes.  The idea is to not allow someone who may pose a
threat to have access to entry points into their homes because it must
be presumed that anyone who would break into a house has malevolent
intentions.

The Presidential Commission on the Terrorist Attacks of September 11,
2001 devoted considerable time and effort into exploring the ways that
the terrorists managed to enter our country and then hide in plain sight
as they prepared to launch the most violent terrorist attack ever
committed on American soil and, arguably, anywhere in the history of the
modern world.  The 9/11 Commission used the term “Embed” to describe
the way that they managed to hide in plain sight including the adopting
and use of some 364 false names and variations of false names.

Commonsense and real life experiences tell us that someone who seeks
to move surreptitiously cannot be trusted.  Even our “hard-wired”
survival instincts that we are born with warn us about anyone or
anything that hides from us.  If you don’t believe me, consider how
young children react to someone suddenly jumping out from a hiding place
and screaming “Boo!” at the child!  Even adults will almost always
exhibit an extreme “startle response” when confronted with that sort of
surprise greeting.

Now I want you to consider how the open borders anarchists repeatedly
talk about how good it would be to get the “undocumented workers” to
come out of the shadows in which they are hiding.  Their solution to
those millions of illegal aliens who routinely hide in plain sight is to
offer them official identity documents in whatever names they would
provide in an application even though there is no easy way for anyone to
really know who they are.  The use of false names by criminals, spies
and terrorists is the equivalent of the camouflage fatigues used by our
combat soldiers- it conceals their true identities from our authorities
who are charged with protecting us from the bad guys.

Yet this is the “solution” that is nearly always offered by those who
favor what they refer to as “Comprehensive Immigration Reform.”  In
part, this is why I have come to refer to such massive amnesty programs
by a far more accurate and descriptive term- I have come to refer to
Comprehensive Immigration Reform as truly being the “Terrorist
Assistance and Facilitation Act.”  On June 22, 2007 the Washington Times
published an opinion piece I wrote that was entitled Immigration bill a ‘No Go’ in which I laid out my concerns.

The ICE news release that served as the basis for my commentary today
reported on how Cesar “El Chilin” Vega-Muñoz had been deported from the
United States in April 2009 after he had attempted entry into the
United States using the false identity documents of another individual.

He was clearly highly motivated to seek to enter the United States
because he is wanted in Mexico for being part of a pernicious kidnapping
ring, El Neto, that reportedly specializes in kidnapping wealthy
businessmen in Ciudad Juarez, Mexico and had been sentenced to serve 42
years in prison and then was aided in escaping from Mexican law
enforcement custody while he was being transported in a van that came
under gunfire from apparent confederates.

What is important to know is that he was arrested by Special Agents
of ICE in El Paso, Texas as he stood outside the restaurant where he
worked as a cook.

I am fairly certain that the patrons of that restaurant had no idea
as to what other “skills” the cook who prepared their food possessed! 
Although not noted in the news release, it is likely that Vega-Munoz was
using false identity documents to conceal his identity and his criminal
history.

IN my many years with the INS, nearly every time we sought a fugitive
who was wanted in another country for committing a serious crime, that
alien was found working on a mundane job and almost always his coworkers
were shocked to find out that the guy with the pleasant smile was a
dangerous and perhaps violent criminal!

Looks can certainly be deceiving!  Yet most folks are quite naive-
think how many times neighbors of a war criminal or particular dangerous
criminal are interviewed by reporters and tell the reporter how the
criminal next door or the terrorist next door was polite and often
smiled benevolently at them.

Certainly the ICE personnel who arrested this dangerous fugitive are
to be lauded for their job well done, but what must also be understood
is that there are many more such fugitives from all over the world who,
at this very moment, are managing to hide in plain sight and if there is
one thing that they undoubtedly pray for every day, is the passage of a
massive amnesty program that would enable them to create brand new
“clean” identities for themselves!

While there was no mention as to how ICE came to become aware of
Vega-Munoz’s presence at the restaurant where he was working and
subsequently arrested, I would venture a guess that the fact that had
been previously deported may have played a role in his being targeted
for arrest.  The administration’s current policy of not seeking to
arrest illegal aliens who have no criminal convictions in the United
States makes it far less likely that a criminal or terrorist who has
embedded himself in a community under an assumed identity will be
discovered for being the bad guy that he truly is.  All that such
criminals or terrorists need to do is to acquire a false identity-
something that is nearly as easy as buying a newspaper these days, and
make certain to not interact with local police.

In this game of “hide and seek” the bad guys are hiding but the good guys have been ordered to not seek!
