On May 21, 2015 I participated in a discussion about a “new” proposal to provide millions of illegal aliens with lawful status as part of a five point plan proposed by a “Conservative” on Newsmax-TV’s program, “Newsmax Prime” hosted by J.D. Hayworth.

Latino Activist: Conservatives Must Lead on Immigration Reform

This plan was heralded in a news release I have attached below. The plan is essential indistinguishable from similar plans proposed by political “Liberals” and supports the fundamental concept that immigration is not about “Left” or “Right” but about right or wrong.

Once again the “solution” to the failures of the immigration system as delineated by Aguilar is to construct a double fence along the US/Mexican border where illegal crossings can potentially occur. The list, which is attached below the press release, also calls for mandatory E-Verify and a biometric system to track the departure of aliens who are admitted as temporary nonimmigrants. Under the plan visas for foreign workers would be issued only if we really needed those workers in the United States if American workers can not be found.

Finally, only after Obama leaves office, unknown millions of illegal aliens would be provided with lawful status including employment authorization after their fingerprints are run and they pay taxes.

These are the five elements of the proposal:

1.) Secure the Border

Extend double fencing to all areas along the southern border, where illegal crossings can potentially occur, to attain effective and realistic operational control of the border.

2.) Enforce Immigration Law at the Workplace

Mandate all businesses use the federal employment eligibility verification system, or E-Verify, to ensure only citizens andindividuals with legal status are employed.

3.) Fully Implement an Entry/Exit Registry

Utilize a biometric tracking system of foreign nationals to ensure theydepart the country by the time their visa expires.

4.) Ensure Employers Can Hire Foreign Workers If Needed

However, only allow this in situations where the employers cannot find American workers first.

5.) Provide a Path to Legal Status for Undocumented Immigrants

After steps 1, 2 and 3 are executed and not earlier than January 21, 2017: provide legal status to undocumented immigrants – including individuals who entered as minors or so-called “dreamers” – after they pay a fine and back taxes.

The discussion only lasted about 4 minutes and so it was difficult- actually, impossible to do an in-depth dissection of this five point plan- however, if you watch the video of the segment and/or read the article about it, you will see that I did my best to cover as many of the failing of this proposal as I could including the fact that we have 50 border states and that the plan did not provide for agents to make certain that all of the enforcement provisions would actually be carried out.

What I did not get the chance to say is that was that the biometric tracking system was a part of the 1996 Immigration Reform Act and was mandated by the 9/11 Commission. In point of fact, I raised the issue of the need to use biometrics in conjunction with immigration law enforcement when I testified before a Congressional hearing on May 20, 1997, approximately 4.5 years before the terror attacks of 9/11. Furthermore, the federal government has spent more than one billion dollars on contracts with Accenture to create this program under the name of US-VISIT. That program was never completed but the goal to accomplish that goal continues under a different name.

Without an adequate number of agents conducting investigations into the process by which labor certifications are granted to provide evidence that American workers cannot be found to do the jobs that foreign companies need done, fraud will permeate the program as it does now.

I was happy to be able to make the point that while all of the discussions about immigration seem to focus on “Latino voters” an insidious form of racial profiling, the United States actually admits more lawful immigrants from China than from any other country. Meanwhile the U.S.’Chinese relationship is getting ever more contentious as China claims that the South China Sea, where it is currently creating artificial islands by a massive dredging operation, is part of their territory. In point of fact, China recently warned U.S. military aircraft that they were intruding on Chinese airspace even though our airplanes were in what every other country considers to be international airspace.

Mr. Aguilar assertions about how adding unknown millions of newly legalized foreign workers into a labor pool of tens of millions of unemployed Americans would magically create more jobs finished off any credibility he may have thought that he had established- although all of the elements of his plan made it clear from the outset that this was just a re-hash of the same old absurd “solutions.”

This is the press release that touted the “Five-Point Plan” The term “Propaganda” comes to mind readily when reading this!

Hispanic Conservative Leader Releases Five-Point Plan
for Congress to Finally Pass Immigration Reform

Aguilar: “This is necessary—it’s politically smart—and it’s the right thing to do.”

Washington, D.C. – Today American Principles in Action released a five-point conservative immigration action plan for Congress to finally pass immigration reform. The plan was released as part of APIA’s first Conservative Immigration Forum, which took place this morning at the Alan P. Kirby, Jr. Center for Constitutional Studies and Citizenship in Washington, D.C.

The plan, which includes a specific timeline and detailed policy proposals, can be found here.

Alfonso Aguilar, Director of APIA’s Latino Partnership, released the following statement:

“Immigration reform has stalled in this Congress, but it’s time to bring the issue back to the forefront. The American people and the Latino community want to see this issue addressed, or at least see us moving toward a resolution, and honestly we all deserve to have it resolved. Today we released a plan that provides a blueprint for Congress to finally pass something substantive that will secure the border, fix our broken visa system, and provide a path to legal status for undocumented immigrants.”

“This is necessary—it’s politically smart—and it’s the right thing to do. We look forward to working with Members of Congress in the coming weeks to introduce legislation and begin our piecemeal approach to passing immigration reform.”

Alfonso Aguilar was joined by several renowned conservative leaders at the Forum, including Lila Rose of Live Action, Matt Schlapp of the American Conservative Union, U.S. Rep. Raul Labrador (R-Idaho), Sen. Ron Johnson (R-Wisconsin), Alex Nowrasteh of the Cato Institute, Terry Schilling of American Principles in Action, and Niger Innis of TheTeaParty.net.

American Principles in Action is a 501(c)(4) organization dedicated to preserving and propagating the fundamental principles on which our country was founded. It aims to return our nation to an understanding that governance via these timeless principles will strengthen us as a country.

To provide you with a bit of additional material, during my remarks at the panel discussion, I referenced an Op-Ed I had written for the Washington Times in which I articulated my concerns about the previous attempt to enact Comprehensive Immigration Reform that the Washington Times published on June 22, 2007. Senator Jeff Sessions quoted from my commentary, on three separate dates, from the floor of the U.S. during the contentious floor debates. In my piece I recommended that Comprehensive Immigration Reform be given a more honest and descriptive title, I suggested that it be renamed the “Terrorist Assistance and Facilitation Act!”

I recommend you review Senator Session’s statement on June 27, 2007 from the floor of the U.S. Senate on the Immigration Bill in which the Senator made reference to my suggested new name to that disastrous legislation in my Washington Times Op-Ed. His impassioned pleas to his colleagues averted a catastrophe and that legislation was defeated. However, not unlike Freddy Krueger, Comprehensive Immigration Reform has been brought back to life through the unilateral actions of President Obama and his proposed executive actions. Furthermore, there are politicians from both parties willing to give this legislative betrayal of America and Americans CPR!

Today our nation and our citizens face a list of challenges and threats- nearly every one of which is being exacerbated by long-standing failures of our nation to secure our borders and enforce our immigration laws. To be clear, it is not “Anti-Immigrant” to want these two issues to be dealt with effectively. In point of fact, the same immigration laws that mandate the categories of aliens to be kept our of our country and the terms under which aliens should be removed from our country have absolutely nothing to do with race, religion or ethnicity, also provide for the lawful admission of roughly one million lawful immigrants and the naturalization of hundreds of thousands of new citizens each year.

It is therefore a contradiction in terms and thinking to claim that it is “Anti-Immigrant” to support the effective enforcement and administration of our immigration laws

Let us be clear in our thinking- it is “Pro-Immigrant” to be “Pro-Enforcement!”

When the issue of immigration comes up most people purely focus on the lack of integrity to the border that is supposed to separate the United States from America. Clearly that border lacks integrity and represents little more than a speed bump to smugglers who transport illegal aliens and contraband including record quantities of dangerous drugs such as heroin and cocaine into the United States.

However, there are many more components to the immigration system including systems by which aliens are granted visas to enter the United States and various immigration benefits such as conferring employment authorization to aliens in the United States and also include the adjudications process by which aliens are granted lawful immigrant status and even United States citizenship.

All of these systems of the immigration system lack integrity. Aliens who have gone on to commit crimes and even participate in terrorist attacks have often been dissevered to have successfully gamed the immigration benefits program in order to embed themselves in communities around the United States as they went about their deadly preparations.

On June 13, 2013 I was interviewed by Neil Cavuto at Fox News on the topic:

“Does immigration reform pose too many risks?”

The interview ran about 4 minutes and is worth watching.

On April 4, 2014, CAPS (Californians for Population Stabilization) posted my commentary that asks the questions all Americans need to ask their political “representatives.” My commentary is aptly titled:  “How? Why?”

In his historic speech before the 3^rd Army on May 31, 1944, General George S. Patton said, on the strategy of holding a position:

“We’re not holding anything, we’ll let the Hun do that. We are advancing constantly, and we’re not interested in holding onto anything except the enemy.”

Pushing back against Comprehensive Immigration Reform is the same as holding position. The time has come for us to advance by demanding that our borders be made truly secure and our immigration laws be effectively administered and enforced.

Comprehensive Immigration Reform violates all of the findings and recommendations of the 9/11 Commission but no one is willing to even consider how the lack of real border security and the lack of real integrity to the various components of the immigration system imperil national security and public safety.

The findings and recommendations of the 9/11 Commission must be the starting point for any discussion about immigration legislation. That commission determined that a lack of border security, including the visa process. and fraud in the immigration benefits program, enabled terrorists to enter and embed themselves in the United States, as they went about their deadly preparations.

Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today! Simply stated, the immigration laws were enacted to save lives and protect the jobs of American workers. In point of fact, our borders and our immigration laws are America’s first line of defense and last line of defense against international terrorists and transnational criminals.

It is not “Anti-Immigrant” to be “Pro-American!”

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within. The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!

If our government’s failures to protect American jobs by securing our nation’s borders and effectively enforcing our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation!

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Latino Activist: Conservatives Must Lead on Immigration Reform

Conservatives must take the lead on immigration reform, and that is why he has introduced a five-point plan to guide Congress to do just that, Alfonso Aguilar, executive director of the Latino Partnership at American Principles and former chief at the U.S. Office of Citizenship, told Newsmax TV.

Appearing Thursday on “Newsmax Prime,” Aguilar said his plan includes more double-layer fencing on the border with Mexico, mandating E-Verify to ensure workers are in the country legally, creating an exit registry to identify those who have overstayed their visas, creating a market-based guest-worker program and then proceed with a legalization program that is not a path to citizenship.

The last two can be accomplished only after President Barack Obama leaves office, he said.

Immigration and Customs Enforcement has no clue who’s overstaying their visas, he said.

“By having an extra registry they can identify those who have overstayers, detain them, and remove them from the country.”

Former Immigration and Naturalization Services officer Michael Cutler, also appearing on the program, disagreed with some of Aguilar’s arguments, saying that there are no provisions in his plan to hire the tens of thousands of agents needed to enforce his proposals.

“Speed limits don’t matter if you don’t have cops out there with … radar detectors,” Cutler said. “No. 2, I saw in your literature that this is about the Latino voter, Latino citizens and Latino Americans. … We’re admitting more people from China legally than from Latin America. This shouldn’t be about race, religion, ethnicity.”

Aguilar said that his plan is simply a “framework,” and doesn’t attempt to deal with every detail of immigration reform.

“We’ve got to do what’s consistent with the 9/11 Commission’s findings and recommendations,” Cutler responded. “They just found the 9/11 Commission report in bin Laden’s hideout along with, believe it or not, an application for citizenship.”

There is no way to screen unknown millions of people who have snuck into the country illegally, Cutler said.

“We admit more than 1 million lawful immigrants every year, unemployment rates are off the chart,” he said. “Bringing in more workers than the number of jobs we’re creating is catastrophic, and then you need to look at the remittances, the money being wired out of the United States by an ever-increasing number of foreign workers.”

Aguilar disagreed, saying that immigration actually helps create more good paying jobs for Americans.

“Immigrants actually complement the skills of American workers,” he said.

Can you get a valid driver’s lcsenie without being a citizen?Sure. A legal resident alien can get a driver’s lcsenie from their state of residence. If not, than having a valid driver’s lcsenie should be sufficient to prove legal citizenship status. However, I know that some mush-headed liberals wanted to issue valid driver’s lcsenies to illegal aliens a while back. I’m not sure if they prevailed. If they did, then a valid driver’s lcsenie is no longer sufficient to establish legal residency.No you mush-headed conservative, you’ve got it wrong. First, a legal resident alien can get a driver’s lcsenie. Second, for example: Their visa can then expire, but that’s federal, and while they are no longer supposed to be here, their state issued drivers lcsenie does not expire.Another scenario: An American citizen with a driver’s lcsenie decides to immigrate to another country, renounces his or her U.S. citizenship and applies for citizenship in the nation they immigrated to. Many states will issue class D driver’s lcsenies valid for a longer time than it takes to change citizenship. Now then, suppose that person re-enters the United States illegally. We know that takes place by walking through the desert in the southwest, and it ain’t hard to get into the U.S. from Canada on forest trails. A non citizen now in possession of what would appear to be a perfectly valid state issued driver’s lcsenie, and no real way to check citizenship during a traffic stop, with or without NCIC, because because NCIC won’t necessarily include the person’s immigration to another country.Therefore, and nothing to do with mush-headed liberals, a driver’s lcsenie cannot be legally admissible evidence of citizenship.Moreover, pedestrians, bicyclists, equestrians, farm equipment operators, etc., are governed by traffic laws just the same as drivers of automobiles, motorcycles, trucks and buses. They can be stopped and cited for traffic law violations BUT you don’t have to have a driver’s lcsenie to ride a horse down the road, and in most states you don’t need a driver’s lcsenie to run a wheel tractor from one field to another on a public highway.Now think about that. We’re NOT TALKING ABOUT American citizens going to prison, or being deported, but we are talking about a system under which American citizens can be arrested and held in custody for hours, or days, or weeks while their identity and citizenship is sorted out.And it is mush-headed to believe that this sort of police power will not be frequently abused, just as it was mush-headed to conclude that a state issued driver’s lcsenie isn’t legally admissible evidence of citizenship or legal alien residency because the liberals supposedly messed it up.

So a state law that enforces a fed law is ierftenrence but laws that are passed to not enforce the law is not ierftenrence? Um I do not get it It is certainly crazy, isn’t it? We’re suing Arizona for enforcing at the state level a law we prefer not to enforce at a federal level. In the meantime, we’re also going to allow sanctuary cities to go untouched because we like the fact that they’re violating federal law. The federal government is totally insane and out of control. All they care about is vote manipulation. Law and the constitution are totally irrelevant.
