Building an Immigration System Worthy of American Values"

Hi Gang:
My focus today is a commentary I wrote for the CAPS (Californians for Population Stabilization) blog that was posted earlier today on their website.

Just about a week ago I was invited to testify before a hearing that was to be conducted on March 20th by the Senate Committee on the Judiciary on the topic:
“Building an Immigration System Worthy of American Values”

For the first time I had my wife and my youngest son accompany me to Washington so that they could watch the proceedings.
I have testified before roughly 15 previous hearings and usually my wife Susan watches the hearings from home when they are streamed live on the internet.  
I certainly welcome the opportunity to share my perspectives and concerns that my career with the former INS has provided me, but the problem is that while there is not shortage of hearings in Washington on just about every topic you could imagine, you sometimes wonder how many of our leaders are really paying attention.
I have had many occasions to want to jump up in the middle of a hearing and, not unlike the guy in the old cell phone commercials ask, “Can you hear me now?”  I have often thought that perhaps rather than hearings they should conduct listenings in Washington!
The “Gang of Eight” are meeting behind closed doors to concoct a scheme (scam?) to foist a massive amnesty program on the United States and its citizens that will irrevocable national security vulnerabilities for the United States.  Yet no one has ever raised this issue in public.  All that we seem to hear about is how providing identity documents to illegal aliens who snuck into the United States will enable them to realize their dreams.  No one is willing to talk about the nightmares that this act of madness would create for American citizens and lawful immigrants!
The laws of nature are immutable.  The speed of light is not dependent on a guy with a radar gun and a summons book to make certain that light travels at the proper velocity.  The speed of vehicles on a highway require enforcement.  Think of how often motorists fly by us on the highway with scant regard to the posted speed limits!
If the law of gravity was dependent on the ability of the government to enforce that law, we would all be floating!
Congress is, as you know, the legislative branch of our government.  They are the law makers.  They often appear oblivious to the fundamental truth, that just requiring that something should be in the law does not mean it can be enforced to make it happen.
They don’t give any thought to determining if requirements that they establish can be readily verified.
These politicians will talk about how important and right it is to give 11 million illegal aliens with lawful status and pathways to citizenship but then ignore several factors-
They ignore what will happen to American workers who would find themselves facing millions of competitors for jobs they desperately need.  (Think about how much politicians hate competitors!  Think about the mud slinging contests that pass for political campaigns.  They will do anything and everything to destroy those who would run against them for public office.  Yet these same competition hating politicians are willing to trip over themselves to create millions of competitors for a too short supply of jobs!
In addition to failing to take unintended consequences into account- they also write laws that may establish reasonable sounding requirements but ignore the fundamental fact that there is no way of verifying if the hapless law enforcement officers who have to enforce those laws or the beleaguered adjudicators can effectively administer those laws.
When we hear, for example, that in order to qualify for participation in an amnesty program the alien must have been in the United States for a designated period of time- for the sake of argument, three years, how in the world can anyone verify how long an illegal alien who evaded the inspections program, has been in the United States?  How they determine the true identity of an alien who is “undocumented” which means that they have no official reliable identity documents?
I welcomed the opportunity to make these points in my testimony- but is anyone really listening?
You can make them listen!
You must contact your elected representatives and raise these issues with them.  You must contact everyone you know and ask- indeed- implore them to do the same!
Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!The immigration laws are supposed to achieve two primary goals- to protect American lives and protect Americans’ jobs.  

Our nation is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda or other terrorist organizations!

It is also vital that American workers never be made to compete with foreign workers for their jobs!  (This requirement is a component of the Immigration Laws that are not being enforced today!)

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws that are intended to protect our nation and our citizens concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

I also ask that you pass this e-mail along to your friends and neighbors- I am attempting to create a “Bucket Brigade of Truth!”

We the People must make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Senate Judiciary Hearing: Building an Immigration System Worthy of American Values

michael_cutlerOn March 20, 2013 the U.S. Senate Judiciary Committee conducted a hearing that should have been of huge importance all the Senate as well as the news media. The hearing should have been reported on to the United States citizens especially since the administration and both political parties may be poised to create the most massive amnesty program ever created for perhaps tens of millions of illegal aliens whose true identities, dates of entry, backgrounds and other vital information cannot be verified.

The 1986 Immigration Reform and Control Act which granted amnesty to more than 3.5 million people would be dwarfed, perhaps by a factor of ten, by the program that the “Gang of Eight” is concocting behind closed doors.

The potential consequences of such a massive amnesty program are supported by the facts.  Consider what just 19 terrorists were able to do on September 11, 2001. The 9/11 Commission, to which I provided testimony, made it clear that the terrorists’ goals could not have been realized had they not been able to enter the United States in the first place. They could not have carried out their plans had they not been able to embed themselves in local communities throughout the United States as they went about their deadly preparations. The 9/11 Commission emphasized that border security, the lax visa issuance process and immigration benefit fraud all played rolls in providing terrorists the ability to hide in plain sight.

Today, more than eleven years after the 9/11 attacks and more than two decades after the 1993 terrorist attacks, the White House and Congress are proceeding in a manner that could be described at the least as foolhardy and at the worst as treasonous.

When he first took office, President Obama promised to create the most transparent government in history. Even Superman’s X-ray vision could not make this administration “transparent!”

Only three Senators, (Chuck Grassley (R-IA), Christopher Coons (D-DE) and Mazie Hirono, D-HI) attended the hearing intermittently. The obvious question is, “Where were the other senators?”

Just about every seat in the audience was filled, but the dais was essentially vacant but for some staffers. Since there was no media presence, most Americans didn’t know the hearing took place.

Immigration impacts virtually every threat and challenge that confronts the United States, yet, you would never know it when you consider who was not there!

Abraham Lincoln described the United States as possessing a government that was “Of the people, by the people and for the people.

That was then, this is now!

To cut to the chase, here’s how I ended my prepared testimony:

     ”Law enforcement is at its best when it creates a climate of deterrence to convince those who might be contemplating violating the law that such an effort is likely to be discovered and that if discovered, adverse consequences will result for the law violators. Current policies and statements by the administration, in my view, encourages aspiring illegal aliens around the world to head for the United States. In effect the starter’s pistol has been fired and for these folks, the finish line to this race is the border of the United States.

     ”Back when I was an INS special agent I recall that Doris Meissner who was, at the time, the commissioner of the INS, said that the agency needed to be ‘customer oriented.’ Unfortunately, while I agree about the need to be customer oriented what Ms. Meissner and too many politicians today seem to have forgotten is that the ‘customers’ of the INS and of our government in general, are the citizens of the United States of America.”
