On June 3rd I was interviewed by Andrew Wilkow on his program that is carried by the Blaze TV Network.

Illegal Immigrant Children Causing Border Crisis

The situation surrounding illegal immigrants sneaking through our southern border is nothing new. But there is now a “humanitarian crisis” taking place down there. Well, the flood of illegal immigrant children is turning out to be worse than originally thought, and things are so bad the President is setting up a special task force to deal with it. FEMA has been tapped to handle the situation and will be coordinating with DHS and HHS to care for the children until they can be reunited with their families. So the Federal Government has turned into a giant day care for Mexico’s unwanted kids.

I have to disagree with the title of the segment posted on the website.  

In my judgement, the administration is creating the crisis and the Illegal alien children are, in reality, the victims of that crisis.

Furthermore that crisis is being exacerbated by politicians from both political parties who seize every possible opportunity to stand before news cameras and microphones and make the fatuous argument that we cannot possibly deport 11 million illegal aliens (or likely many, many more and many more arriving daily) and then debate whether or not to provide illegal aliens with a pathway to lawful status or a pathway to United States citizenship.  

The fact that only a tiny fraction of those who violate all of our other laws are ever caught or punished is blithely (conveniently) ignored..

The inspections process conducted at ports of entry, that aliens who run our borders evade, is supposed to prevent the entry of aliens into the United States whose presence wold be harmful or deadly to America and Americans and, in fact, all who are present in the United States irrespective of their citizenship.
While advocates for Comprehensive Immigration Reform refer to aliens who evade the inspections process as simply being “Undocumented” in an obvious attempt to minimize the true significance of how they violated our laws, the hard truth is that they are un-inspected.  The term my colleagues and I used at the former INS to describe this method of entering the United States is EWI (Entry Without Inspection).  As I noted in my interview on Wilkow on the BlazeTV, no rational person would get on board an airliner if he (she) saw fellow passengers get onto that airplane after sneaking past the TSA personnel at an airport.  Today, however, Americans in every town and city across this vast nation are being forced to live among unknown millions of foreign nationals who evaded a similar inspection process conducted at ports of entry.
One of the sections of the Immigration and Nationality Act (INA) is Title 8, United States Code, Section 1182 which enumerates the categories of aliens who are to be excluded. Among these classes are aliens who suffer from dangerous communicable diseases or extreme mental illness. Additionally convicted felons, human rights violators, war criminals, terrorists and spies are excluded as well as aliens who would seek unlawful employment or become public charges.

The Border Patrol has been relegated to providing concierge service for illegal aliens and their families when in reality, this important law enforcement agency should be using its limited resources to enforce our immigration laws and secure our borders.  Those laws and our borders are America’s first line of defense and last line of defense against international terrorists, transnational criminals, spies and aliens who may suffer from dangerous communicable diseases.  Simply stated, this is about national security, public safety and the wellbeing of America and Americans.
The failures of the component agencies of the DHS (Department of Homeland Surrender) to secure our borders and enforce our laws and the statements made by the politicians serve to aid, abet, encourage and induce aliens to illegally enter the United States and easily embed themselves (hide in plain sight).  While so many politicians demand that illegal aliens and those who intentionally hire illegal aliens should face legal consequences, the reality is that the politicians I noted above are also committing felonies as are political leaders who proclaim their towns, cities and states to be “Sanctuaries” for illegal aliens.  

Consider that under 8 USC § 1324 – Bringing in and harboring certain aliens, a section of law that is comprehended within the Immigration and Nationality Act (INA), it is a felony to aid, abet, encourage or induce aliens to enter our country illegally or remain in our country illegally.

Here is an excerpt from that section of law:

Title 8, U.S.C. § 1324(a) Offenses

Title 8, U.S.C. § 1324(a) defines several distinct offenses related to aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic transportation of unauthorized aliens, concealing or harboring unauthorized aliens, encouraging or inducing unauthorized aliens to enter the United States, and engaging in a conspiracy or aiding and abetting any of the preceding acts. Subsection 1324(a)(2) prohibits bringing or attempting to bring unauthorized aliens to the United States in any manner whatsoever, even at a designated port of entry. Subsection 1324(a)(3).
Harboring — Subsection 1324(a)(1)(A)(iii) makes it an offense for any person who — knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals harbors, shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation.
Encouraging/Inducing — Subsection 1324(a)(1)(A)(iv) makes it an offense for any person who — encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law.
Conspiracy/Aiding or Abetting — Subsection 1324(a)(1)(A)(v) expressly makes it an offense to engage in a conspiracy to commit or aid or abet the commission of the foregoing offenses.

Rather than deterring additional illegal immigration, these politicians have fired the starter’s pistol and for aspiring illegal aliens around the world, the finish line is the border of the United States.  In point of fact, this is essentially a point I made when I testified before the U.S. Senate Judiciary Committee hearing on March 20, 2013 on the topic:
I would ask that you take the time to read my prepared testimony its entirety.
Here is how concluded my prepared testimony at that hearing- it will serve to end my e-mail today as well:
Adding to this, we have the problem of prosecutorial discretion
where the administration has not been arresting illegal aliens, and
most recently was the releasing of the criminal aliens, in fact, that
Senator Grassley talked about.
I want to make this clear: Law enforcement is at its best when
it creates a climate of deterrence to convince those who might be
contemplating violating the law that such an effort is likely to be
discovered and that, if discovered, adverse consequences will result
for the law violators. Current policies and statements by the ad-
ministration, in my view, encourages aspiring illegal aliens from
around the world to head for the United States. In effect, the start-
er’s pistol has been fired, and for these folks, the finish line to this
race is the border of the United States.
Back when I was an INS special agent, I recall that Doris Meiss-
ner, who was at the time the Commissioner of the INS, said that
the agency needed to be ‘‘customer oriented.’’ Unfortunately, while
I agree about the need to be customer oriented, what Ms. Meissner
and apparently too many politicians today seem to have forgotten
is that the ‘‘customers’’ of the INS and of our Government in gen-
eral are the citizens of the United States of America.

The importance of our borders and our immigration laws cannot be overemphasized.  In the war on terror and transnational gangs, they are our first line of defense and our last line of defense against international terrorists and transnational criminals.  They are equally important to American workers who are facing unfair competition from foreign workers, aided and abetted by the administration and advocates for “Sanctuary Cities” and Comprehensive Immigration Reform.  

The starting point for any conversation or legislation concerning immigration must be the findings and recommendations of the 9/11 Commission which determined that a lack of border security, including the visa process. and fraud in the immigration benefits program enabled terrorists to enter and embed themselves in the United States, as they went about their deadly preparations.

In his historic speech before the 3rd Army on May 31, 1944, General George S. Patton said, on the strategy of holding a position:

“We’re not holding anything, we’ll let the Hun do that. We are advancing constantly, and we’re not interested in holding onto anything except the enemy.”

Pushing back against Comprehensive Immigration Reform is the same as holding position. The time has come for us to advance by demanding that our borders be made truly secure and our immigration laws be effectively administered and enforced.

Comprehensive Immigration Reform violates all of the findings and recommendations of the 9/11 Commission but no one is willing to even consider how the lack of real border security and the lack of real integrity to the various components of the immigration system imperil national security and public safety.

Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  Simply stated, the immigration laws were enacted to save lives and protect the jobs of American workers.

It is not “Anti-Immigrant” to be “Pro-American!”

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!

If our government’s failures to protect American jobs by securing our nation’s borders and effectively enforcing our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!
