I just spotted this commentary in today’s edition of the Washington Times, that was written by Congressman Lamar Smith, the Chairman of the House Judiciary Committee and noticed a striking similarity with my commentary that appears today on the CAPS website- including the title.

Clearly Chairman Smith and I are on the same wavelength concerning the outrageous statements made by President Obama and Secretary of Homeland Surrender, Janet Napolitano.
However, I believe that, as I noted in my commentary, the issue is not just whether or not our borders are secure- clearly they are not:  The issue is the utter lack of integrity where every component of what should be a coherent immigration system is concerned.
Certainly our borders must be made secure but the rampant fraud that permeates the process by which aliens are granted a wide variety of immigration benefits including the conferring of lawful immigrant status and even United States citizenship upon aliens threatens national security, community safety and encourages still more fraud that creates a vicious cycle of higher numbers of applications for more immigration benefits containing fraud that leads to the adjudications officers at USCIS (United States Citizenship and Immigration Services) to have to work ever faster in a futile effort to keep up with the upwardly spiraling of number of applications to be adjudicated leading to more fraud and still more aliens are encouraged to file fraud laden applications!
The way that United States Citizenship and Immigration Services (USCIS) has made the rapid processing of massive numbers of applications for various immigration benefits including the conferring of lawful immigrant (resident alien status) and United States citizenship upon aliens- quality control has gone out the window!  As I have noted on ever so many other occasions, the way that the hapless adjudicators at USCIS are prodded, cajoled, rewarded, brow beaten and otherwise induced to move the bureaucratic conveyor belt as quickly as possible is reminiscent of the way that Lucy and Ethel in a particularly hilarious episode of “I Love Lucy” were expected to wrap morsels of candy that was delivered to them on a conveyor belt.  At first the conveyor belt moves at a reasonable pace and they manage to properly wrap each bonbon with no drama.  Then the belt begins to pick up speed and the fun begins!  The two women try to keep up but are quickly unable to deal with the onslaught of the bonbons as the belt continues to accelerate.  They try to eat some of the candy and stuff other morsels of candy down their clothes while the belt continues to go ever faster, ultimately causing the candy to hurtle at them at warp speed.

As the belt picks of speed, Lucy is heard to tell her friend Ethel, “I think we are fighting a losing game!”
The segment is extremely funny- but now imagine that Lucy and Ethel are adjudicators at USCIS and instead of candy flying at them they are inundated with applications for various immigration benefits including citizenship.  Consider how United States citizenship given to a terrorist has severe national security implications.
The adjudications officers at USCIS are also “fighting a losing game!”  If they lose- we all lose!
As I have noted in so many previous commentaries, USCIS is the very same agency that would be tasked with administering Comprehensive Immigration Reform as well as the DREAM Act, which according to a news report issued earlier today- is, believe it or not, being resurrected once again!
The advocates for those two legislative betrayals of our nation and our citizens, the DREAM Act and Comprehensive Immigration Reform are, once again, attempting to make it seem reasonable that once our borders are declared to be secure that it is appropriate for those legislative nightmares to be enacted.  Nothing could be further from the truth!
All components of the “Immigration System” must be made to possess solid integrity- not as a precursor to Comprehensive Immigration Reform or the DREAM Act but as a way of addressing what is arguably the most fundamental instinct of all humans and, in fact, any sentient creature- the instinct for survival!
The statements made by the advocates of these immigration bills will say all sorts of outlandish things to attempt to convince the citizens of this nation that this is the only way of dealing with the immigration crisis that confronts our nation today.  Of course their arguments are as fallacious as were the statements of the President in El Paso on May 10th.
They will say that aliens that would participate in these bills would be placed on the “back of the line.”  (How many times have we heard that statement?!)
Here is the question about that statement- “Where is the line?”  I can tell you that the line they refer to would form inside the United States!  While they wait on that line, they will be in the United States, living and working lawfully!  Meanwhile aliens who are following the laws and playing by the rules will be waiting on their lines except most of them will be waiting on lines in their home countries!  So what does this really mean?  It means that the politicians who make these statements are counting on the fellow Americans to be utterly stupid!  They are counting on Americans being too busy watching baseball and television programs to be paying attention to the fact that they are lying about how this would work!     
As I have noted before, illegal aliens who are, to use the term coined by the open borders advocates going back to Jimmy Carter to describe illegal aliens is “undocumented.”
This means that they lack documents.  Documents that provide reliable proof as to their true names, countries of citizenship, backgrounds, potential affiliation with criminal and/or terrorist organizations and other important facts- particularly significant in an era of Terror Watch Lists, No Fly Lists and the greatly reduced expectations of privacy and freedom for our citizens out of a concern about national security.  It has been determined that of 94 terrorists who were identified as operating in our country in the decade preceding the attacks of 9/11 that 59 of those terrorists (approximately 2/3) used visa fraud and/or immigration fraud to enter the United States and/or embed themselves in the United States in furtherance of their terrorist plans.  Proving illegal aliens with official identity documents when it is patently impossible to readily determine their true identity would irrevocably compromise national security and imperil our nation and our citizens- and not just because terrorists are likely to seize this golden opportunity to morph into a new identity, but criminals and fugitives as well!
When we speak about aliens being illegally present, we must understand what illegal means.  There are some folks who simply say, “Illegal is illegal!”  They expect that this will convince their fellow Americans to demand no amnesty for illegal aliens.  I, however, do not believe that such a simplistic slogan is sufficient to make a compelling case.  Let’s face it, jay walking is illegal and so is failing to clean up after our dogs along with many other such lawful requirements that our government on all levels impose on us.
What does make a compelling case against rewarding aliens who violate our laws and our borders is to be found in Title 8, United States Code, Section 212.  This is a component of the voluminous Immigration and Nationality Act that enumerates the grounds under which an alien should be barred from entering the United States.  Here is a link to that important section of law:

It includes aliens who suffer from dangerous communicable diseases, aliens who suffer mental illness and are prone to violence aliens who are convicted felons, aliens who traffic in narcotics or human beings, aliens who are war criminals or who have committed human rights violations, are engaged in terrorism or in espionage.  The list is far longer and you can read all of these reasons that under the law, aliens are supposed to be prevented from entering our country or may be removed (deported) from our country.  This section of law is designed to protect our nation and all those who are present in the United States.  This section of law is no mere technicality but is of extremely great importance.

Additionally, when aliens run our borders, they leave no record of their entry- creating further national security threats for our nation.  Aliens who evade the inspections process must be presumed to have done so because they know that they would be denied entry because they fall under one or more of the categories of aliens who are statutorily barred from entering the United States.  This is why we must never provide the arguably tens of millions of illegal aliens with official identity documents, lawful status and ultimately- a “pathway to United States citizenship!”

While the open border advocates, such as President Obama and the other “usual suspects” like to portray those of us who oppose such legislative lunacy as being bigoted or racist, the point is that the immigration laws are completely, totally and utterly blind as to race, religion and/or ethnicity!  In fact, all too often the victims of ethnic crime perpetrated by transnational criminals from the four corners of the globe and are of every race, religion and ethnicity imaginable, are the members of the immigrant communities that are most similar to these criminals.  This is true in the Russian communities, the Asian communities, the Caribbean communities, the European Communities as well as the Latino communities.
Another point that is almost never made is that back in 1986 when the first amnesty was enacted, the newly legalized aliens who approached their bosses with their new immigration documents that signified that they were now legally present and demanded that they be paid prevailing wages and had all of the appropriate deductions taken out of their paychecks and had all of the labor standards complied with- were often fired!  They were quickly replaced by the next wave of illegal aliens which is how our country came to experience the greatest influx of illegal aliens in the history of our nation!  There is absolutely no reason to not think that the same sort of situation would not occur if Comprehensive Immigration Reform was to be enacted now!  
Our nation is still suffering from the worst economic crisis since the Depression.  It is estimated that one in five American families is living below the poverty line and foreclosures on homes is at record levels!  As more homes are foreclosed, more houses are dumped on the real estate market further driving down the value of houses on the market.  This is classic economics.  As more houses are foreclosed and the owners are moved out of the houses- in addition to the trauma that this creates for the families that suddenly find themselves forced out of their houses- a trauma that may well cause them and their children to suffer permanent psychological effects, this profusion of abandoned homes also drive down the value of the homes in which the homeowners are still living in that community.  Crime is likely to increase in those communities as abandoned homes may serve as “crash pads” for drug addicts and prostitutes.
Why on earth would our country now want to create a situation that may well mirror what happened in the wake of the Amnesty of 1986 but where the numbers now may well be ten times as high as they were back then?
I certainly agree with Chairman Smith about how the administration is distorting the truth about the issue of border security- but, as I noted above, this is only one of many components of the immigration system that must be addressed to secure our nation and protect our citizens! 

The securing of our nation’s borders and the effective enforcement and administration of our nation’s immigration laws are, arguably, among the most important of all missions that are supposed to be carried out by our federal government.  

Nothing less than the security of our nation and safety of our citizens hang in the balance!
A country without secure borders can no more stand than can a house without walls!

I

our country is to survive and if our children and their children are to get their share of the “American Dream” the citizens of this nation must take their citizenship seriously!

We the People must be the best citizens we can be, citizens who are worthy of the gallantry demonstrated by our valiant men and women in the military, law enforcement and firefighters, who routinely go in harm’s way in defense of this nation and our citizens.  
My goal in writing this and other commentaries is to point out our nations many failings before more victims pay the ultimate price for the incompetence and ineptitude of our government.
The first step in problem-solving is to first identify the problems and vulnerabilities and then devise strategies to overcome them.
If you find yourself to be in agreement with this commentary, I ask that you forward it to as many of your friends and family members as possible and encourage them to do the same.  We need to create a “Bucket Brigade of Truth!”

The practice of good citizenship does not end in the voting booth, it only begins there.

The large scale apathy demonstrated by citizens of this nation has emboldened elected representatives to all but ignore the needs of the average American citizen in a quest for massive campaign funds and the promises of votes to be ostensibly delivered by special interest groups. There is much that we cannot do but there is one thing that We the People absolutely must do- we must stop sitting on the sidelines!


The collective failure of We the People to get involved in make our concerns known to our politicians have nearly made the concerns of the great majority of the citizens of this nation all but irrelevant to the politicians.  
I believe our nation’s is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda!

If this situation concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Lead, follow or get out of the way!

As the adage goes, “If at first you don’t succeed, try, try again.”
But according to the Obama administration, if at first you don’t
succeed, manipulate the results. This especially applies to its border
security plan.

During a recent hearing of the Senate Committee on
Homeland Security, Department of Homeland Security (DHS) Secretary Janet
Napolitano unveiled plans to develop a “border security index” to
measure enforcement progress along the southwestern border.

According
to Miss Napolitano, the border security index will include crime,
immigration and economic data. She thinks this new test will produce a
passing grade for the administration and back their claims that the
border is more secure than ever.

Among their repeated talking
points, administration officials claim the border is secure because
deportations are up and apprehensions are down. But it appears they have
inflated their professed border security achievements.

The Obama administration used questionable methods to achieve the record deportation numbers.

In
fact, DHS’ Immigration and Customs Enforcement (ICE) included more than
19,000 immigrants who had exited the previous fiscal year. ICE also
continued operation of a Mexican repatriation program five weeks longer
than it had done previously, allowing the agency to count at least 6,500
exits that otherwise would not have been included. ICE also used
“voluntary return” to bolster deportation numbers, but this is not
removal because it does not subject an illegal immigrant to penalties
for returning to the United States.

Another media report
highlights allegations by some local law enforcement and Border Patrol
agents that they have been ordered to stop apprehending illegal
immigrants crossing the U.S.-Mexico border.

Based on its report
card, the Obama administration’s new border security index will be
nothing short of manipulated facts and figures toprovide an excuse to
say the border is secure. But if the border security index were based on
fact rather than fiction, it would be better named an Insecurity Index.

According
to the Government Accountability Office (GAO), of the nearly 2,000
miles separating the United States and Mexico, just 44 percent are under
the “operational control” of the Border Patrol and just 15 percent are
under “full control.” Less than 50 percent is a failing grade. The GAO
also found that efforts by the Border Patrol to stop illegal crossings
were “poor.”

Mexican drug cartels are out of control, and the
violence threatens to spill over into the United States. In the past
five years, more than 35,000 people have been killed in Mexico because
of drug-related violence. Recently, an Immigrations and Customs
Enforcement agent was killed and another injured when their vehicle was
shot at by unidentified gunmen.

Last year alone, three Americans
lost their lives because of drug-related border violence. In 2010, there
also were more than 1,000 incidents of violence against Border Patrol
agents. In December, Border Patrol Agent Brian A. Terry was shot and
killed while doing his job of protecting the border.

Each year,
millions of illegal immigrants try to enter the United States. During
fiscal 2010, nearly half a million people were apprehended trying to
enter the country illegally – and those are just the ones we caught.Border Patrol agents on the ground estimatethere
are three successful illegal entries for every one illegal immigrant
who is apprehended. That means more than 1 million illegal immigrants
cross into the U.S. each year.

No matter what kind of index the
administration manufactures, it cannot change the facts. The truth is
that there are massive holes in security along the southern border and
the Obama administration has ignored this growing problem for the past
two years.

The administration’s index is just a cover-up for
inaction. There is no substitute for improved border security coupled
with increased interior enforcement of drug and immigration laws.

The
administration wants to change the test until it comes up with the
results it wants. But it will not succeed in convincing the American
people that the border is secure.
