On May 21, 2015 I participated in a discussion about a “new” proposal to provide millions of illegal aliens with lawful status as part of a five point plan proposed by a “Conservative” on Newsmax-TV’s program, “Newsmax Prime” hosted by J.D. Hayworth.

This plan was heralded in a news release I have attached below.  The plan is essential indistinguishable from similar plans proposed by political “Liberals” and supports the fundamental concept that immigration is not about “Left” or “Right” but about right or wrong.
Once again the “solution” to the failures of the immigration system as delineated by Aguilar is to construct a double fence along the US/Mexican border where illegal crossings can potentially occur.  The list, which is attached below the press release, also calls for mandatory E-Verify and a biometric system to track the departure of aliens who are admitted as temporary nonimmigrants.  Under the plan visas for foreign workers would be issued only if we really needed those workers in the United States if American workers can not be found. 
Finally, only after Obama leaves office, unknown millions of illegal aliens would be provided with lawful status including employment authorization after their fingerprints are run and they pay taxes.

These are the five elements of the proposal:

1.) Secure the Border

Extend double fencing to all areas along the southern border, where illegal crossings can potentially occur, to attain effective and realistic operational control of the border.

2.) Enforce Immigration Law at the Workplace

Mandate all businesses use the federal employment eligibility verification system, or E-Verify, to ensure only citizens andindividuals with legal status are employed.

3.) Fully Implement an Entry/Exit Registry

Utilize a biometric tracking system of foreign nationals to ensure theydepart the country by the time their visa expires.

4.) Ensure Employers Can Hire Foreign Workers If Needed

However, only allow this in situations where the employers cannot find American workers first.

5.) Provide a Path to Legal Status for Undocumented Immigrants

After steps 1, 2 and 3 are executed and not earlier than January 21, 2017: provide legal status to undocumented immigrants – including individuals who entered as minors or so-called “dreamers” – after they pay a fine and back taxes.


The discussion only lasted about 4 minutes and so it was difficult- actually, impossible to do an in-depth dissection of this five point plan- however, if you watch the video of the segment and/or read the article about it, you will see that I did my best to cover as many of the failing of this proposal as I could including the fact that we have 50 border states and that the plan did not provide for agents to make certain that all of the enforcement provisions would actually be carried out.

What I did not get the chance to say is that was that the biometric tracking system was a part of the 1996 Immigration Reform Act and was mandated by the 9/11 Commission.  In point of fact, I raised the issue of the need to use biometrics in conjunction with immigration law enforcement when I testified before a Congressional hearing on May 20, 1997, approximately 4.5 years before the terror attacks of 9/11.  Furthermore, the federal government has spent more than one billion dollars on contracts with Accenture to create this program under the name of US-VISIT.  That program was never completed but the goal to accomplish that goal continues under a different name.
Without an adequate number of agents conducting investigations into the process by which labor certifications are granted to provide evidence that American workers cannot be found to do the jobs that foreign companies need done, fraud will permeate the program as it does now.  
I was happy to be able to make the point that while all of the discussions about immigration seem to focus on “Latino voters” an insidious form of racial profiling, the United States actually admits more lawful immigrants from China than from any other country.  Meanwhile the U.S.’Chinese relationship is getting ever more contentious as China claims that the South China Sea, where it is currently creating artificial islands by a massive dredging operation, is part of their territory.  In point of fact, China recently warned U.S. military aircraft that they were intruding on Chinese airspace even though our airplanes were in what every other country considers to be international airspace.
Mr. Aguilar assertions about how adding unknown millions of newly legalized foreign workers into a labor pool of tens of millions of unemployed Americans would magically create more jobs finished off any credibility he may have thought that he had established- although all of the elements of his plan made it clear from the outset that this was just a re-hash of the same old absurd “solutions.”
This is the press release that touted the “Five-Point Plan”  The term “Propaganda” comes to mind readily when reading this!

Washington, D.C. – Today American Principles in Action released a five-point conservative immigration action plan for Congress to finally pass immigration reform. The plan was released as part of APIA’s first Conservative Immigration Forum, which took place this morning at the Alan P. Kirby, Jr. Center for Constitutional Studies and Citizenship in Washington, D.C.

Alfonso Aguilar, Director of APIA’s Latino Partnership, released the following statement:

“Immigration reform has stalled in this Congress, but it’s time to bring the issue back to the forefront. The American people and the Latino community want to see this issue addressed, or at least see us moving toward a resolution, and honestly we all deserve to have it resolved. Today we released a plan that provides a blueprint for Congress to finally pass something substantive that will secure the border, fix our broken visa system, and provide a path to legal status for undocumented immigrants.”

“This is necessary—it’s politically smart—and it’s the right thing to do. We look forward to working with Members of Congress in the coming weeks to introduce legislation and begin our piecemeal approach to passing immigration reform.”

On April 4, 2014, CAPS (Californians for Population Stabilization) posted my commentary that asks the questions all Americans need to ask their political “representatives.”  My commentary is aptly titled:  “How? Why?

In his historic speech before the 3rd Army on May 31, 1944, General George S. Patton said, on the strategy of holding a position:

We’re not holding anything, we’ll let the Hun do that. We are advancing constantly, and we’re not interested in holding onto anything except the enemy.”

Pushing back against Comprehensive Immigration Reform is the same as holding position. The time has come for us to advance by demanding that our borders be made truly secure and our immigration laws be effectively administered and enforced.

Comprehensive Immigration Reform violates all of the findings and recommendations of the 9/11 Commission but no one is willing to even consider how the lack of real border security and the lack of real integrity to the various components of the immigration system imperil national security and public safety.

The findings and recommendations of the 9/11 Commission must be the starting point for any discussion about immigration legislation.  That commission determined that a lack of border security, including the visa process. and fraud in the immigration benefits program, enabled terrorists to enter and embed themselves in the United States, as they went about their deadly preparations.

Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  Simply stated, the immigration laws were enacted to save lives and protect the jobs of American workers.  In point of fact, our borders and our immigration laws are America’s first line of defense and last line of defense against international terrorists and transnational criminals.
It is not “Anti-Immigrant” to be “Pro-American!”

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!
If our government’s failures to protect American jobs by securing our nation’s borders and effectively enforcing our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Conservatives must take the lead on immigration reform, and that is why he has introduced a five-point plan to guide Congress to do just that, Alfonso Aguilar, executive director of the Latino Partnership at American Principles and former chief at the U.S. Office of Citizenship, told Newsmax TV.  

Appearing Thursday on “Newsmax Prime,” Aguilar said his plan includes more double-layer fencing on the border with Mexico, mandating E-Verify to ensure workers are in the country legally, creating an exit registry to identify those who have overstayed their visas, creating a market-based guest-worker program and then proceed with a legalization program that is not a path to citizenship.

The last two can be accomplished only after President Barack Obama leaves office, he said.

Immigration and Customs Enforcement has no clue who’s overstaying their visas, he said. 

“By having an extra registry they can identify those who have overstayers, detain them, and remove them from the country.”

Former Immigration and Naturalization Services officer Michael Cutler, also appearing on the program, disagreed with some of Aguilar’s arguments, saying that there are no provisions in his plan to hire the tens of thousands of agents needed to enforce his proposals.

“Speed limits don’t matter if you don’t have cops out there with … radar detectors,” Cutler said. “No. 2, I saw in your literature that this is about the Latino voter, Latino citizens and Latino Americans. … We’re admitting more people from China legally than from Latin America. This shouldn’t be about race, religion, ethnicity.”

Aguilar said that his plan is simply a “framework,” and doesn’t attempt to deal with every detail of immigration reform.

“We’ve got to do what’s consistent with the 9/11 Commission’s findings and recommendations,” Cutler responded. “They just found the 9/11 Commission report in bin Laden’s hideout along with, believe it or not, an application for citizenship.”

There is no way to screen unknown millions of people who have snuck into the country illegally, Cutler said.

“We admit more than 1 million lawful immigrants every year, unemployment rates are off the chart,” he said. “Bringing in more workers than the number of jobs we’re creating is catastrophic, and then you need to look at the remittances, the money being wired out of the United States by an ever-increasing number of foreign workers.”

Aguilar disagreed, saying that immigration actually helps create more good paying jobs for Americans. 

“Immigrants actually complement the skills of American workers,” he said.
