My Commentary: “Immigration Tunnel Vision”

Hi Gang:
The president gave his State Of The Union Address yesterday, January 28th and, as expected, he once again called for passage of Comprehensive Immigration Reform.  
He stated that enactment of Comprehensive Immigration Reform would be good for the economy of the United States. but blithely ignored that last year at least $200 billion was wired from the United States to the home countries of foreign workers who are working in the United States.  Because of the “multiplier effect” this has the impact of increasing American deficit by more than one half billion dollars, each and every year.  He also ignored that Comprehensive Immigration Reform would increase the amount of remittances wired from the United States. 
He also ignored how flooding the labor  pool with more workers would drive down wages and shrink the tax  base.
This administration has, unfortunately, acquired the reputation of never letting the facts get in the way of an agenda.
The president also claimed unemployment was at the lowest levels in five years.
The responses of the Republicans who were interviewed on the news programs should be disconcerting to all Americans.  The purpose for America’s immigration laws is two-fold, to protect innocent lives and the jobs of American workers.  In an era in which the threat of terrorism is hangs over our heads, not unlike the Sword of Damocles and the continuing economic hardship being faced by ever so many Americans who are finding it increasingly difficult to find decent jobs to enable them to support themselves and their families, it is utter folly to think that it makes sense to provide unknown millions of illegal aliens with identity documents and add millions of newly authorized workers to the labor pool- a pool that is overflowing with desperate American workers.
My commentary for CAPS (Californians for Population Stabilization) was predicated on remarks made by the politicians who weighed in on Comprehensive Immigration Reform and is posted, in its entirety, to the bottom of this e-mail.

The news media is quick to identify concerns about Comprehensive Immigration Reform as only being the issue of concern for extreme conservatives.  This effort to marginalize Americans who are concerned about national security and widespread poverty among growing numbers of American families and American children is outrageous.  Should the “take away” be that only political conservatives are smart enough to understand how critically important secure borders and effective immigration law enforcement is to the safety and well being of our nation and our citizens?
On January 25, 2014 The Daily Caller posted a short and to the point article concerning Senator Jeff Sessions’ statement on Comprehensive Immigration Reform: 
Here is what is contained in that important and pithy article:
Republican Sen. Jeff Sessions wants wealthy CEOs

 to butt out of immigration policy.

“America is not an oligarchy… A Republic must answer to the people,” Sessions said today, in a direct response to President Barack Obama’s latest effort to get wealthy California CEOs to increase their support for his unpopular push for increased immigration.

“Congressional leaders must forcefully reject the notion, evidently accepted by the president, that a small cadre of CEOs can tailor the nation’s entire immigration policy to suit their narrow interests,” Sessions declared in a populist statement that contradicts the media’s image of Republican coziness with CEOs.

Senator Sessions truly “gets it” and speaks forcefully for the well-being of all Americans!  He is arguably America’s most populist senator!
For him it is obvious that immigration is not about left or right but about right or wrong!

The interview ran about 4 minutes and is worth watching.

In his historic speech before the 3rd Army on May 31, 1944, General George S. Patton said, on the strategy of holding a position:

We’re not holding anything, we’ll let the Hun do that. We are advancing constantly, and we’re not interested in holding onto anything except the enemy.”

Pushing back against Comprehensive Immigration Reform is the same as holding position. The time has come for us to advance by demanding that our borders be made truly secure and our immigration laws be effectively administered and enforced.

Comprehensive Immigration Reform violates all of the findings and recommendations of the 9/11 Commission but no one is willing to even consider how the lack of real border security and the lack of real integrity to the various components of the immigration system imperil national security and public safety.
Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  Simply stated, the immigration laws were enacted to save lives and protect the jobs of American workers.
It is not “Anti-Immigrant” to be “Pro-American!”

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!

If our government’s failures to protect American jobs by securing our nation’s borders and effectively enforcing our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Time and again, politicians who discuss immigration and the need for what they deem “reform” talk about the need to “First secure the border.”

On January 28, 2014 President Obama gave his State Of The Union Address and, not surprisingly, called for passage of Comprehensive Immigration Reform. He did not spend much time on this- apparently seeking to not alienate the Republicans whose support in the House of Representatives is essential if this legislative betrayal of America and Americans is to succeed.

Afterwards, Senator Rand Paul discussed the President’s State of the Union Address. When he got to immigration he made some statement about the need to have annual reviews of the security of the U.S./Mexican border to determine if more visas should be issued each year.

He did not say how he would measure border security. He also ignored the obvious- there is no nexus between securing the U.S./Mexican border and the issuance of visas for foreign workers.

Stop and consider the many ways in which aliens gain entry to the United States. Go back to the point I have made innumerable times about America having “50 border states.”

The United States has a northern and a southern border. The United States has an estimated 95 thousand miles of coastline dotted with marinas and seaports. The United States has many international airports. All of these provide access to the United States.

Yet Senator Paul like most politicians, focused purely on the U.S./Mexican border.

Certainly that border must be made secure, but the myriad other components of the immigration system must also be effectively addressed. Nearly every alien who runs our borders or stows away on a ship or violates the terms of his lawful entry into the U.S., does so to gain a low-paying job.

Aliens who are granted work visas, such as the H-1B visas, are legally admitted into the United States to do highly skilled jobs that pay considerably more than the relatively menial jobs illegal aliens take. The process by which these visa applications are adjudicated has absolutely no relevance to securing America’s borders against illegal aliens.


The challenge in the visa adjudications process is to combat fraud, to make certain that the job for which the visa application is filed actually exists and that the alien has the requisite skills and education to do that job. Additionally, it is vital as the law (Title 8, United States Code, Section 1182) stipulates:


(I) there are not sufficient workers who are able, willing, qualified (or equally qualified in the case of an alien described in clause (ii)) and available at the time of application for a visa and admission to the United States and at the place where the alien is to perform such skilled or unskilled labor, and

(II) the employment of such alien will not adversely affect the wages and working conditions of workers in the United States similarly employed.


All too often lawyers game the process and consequently, highly qualified and experienced Americans lose their jobs to foreign workers. Unlike the immutable laws of nature,, the immigration laws are meaningless unless they are enforced. Not one politician who advocates for “Immigration Reform” has ever advocated for hiring many more agents for ICE to address rampant fraud or the other failures of the immigration system, focusing purely on the security of the border that is supposed to separate the United States for Mexico.

Politicians who are supposedly in favor of “getting tough” on immigration by securing the border simultaneously call for increasing the number of visas such as the H-1B visas, blithely ignoring the plight of American STEM students and American STEM workers.

Two cases in point:

Representative Cathy McMorris Rodgers who was called upon to provide the Republican rebuttal to the State of the Union talked about attracting more highly skilled foreign workers.

Senator Ted Cruz, however, is truly leading the charge against American STEM professionals. He has been consistently very specific about what he wants where H-1B visas are concerned. He provided an amendment to S.744 referred to as “Cruz 5” which, incredibly, provide for a 500% increase in the cap for H-1B visas. His amendment would have increased the current annual cap of 65,000 such visas to an outrageous 325,000 high tech workers. The video of statements by Cruz at a Senate hearing on this issue make his anti-American worker position abundantly clear.

Meanwhile American high tech workers are suffering an unemployment rate that is more than that of other American workers.

Furthermore, The 9/11 Commission Staff Report on Terrorist Travel warned about the nexus between visa and immigration benefit fraud and national security. Page 47 of this report noted:


Once terrorists had entered the United States, their next challenge was to find a way to remain here. Their primary method was immigration fraud. For example, Yousef and Ajaj concocted bogus political asylum stories when they arrived in the United States. Mahmoud Abouhalima, involved in both the World Trade Center and landmarks plots, received temporary residence under the Seasonal Agricultural Workers (SAW) program, after falsely claiming that he picked beans in Florida.


On November 21, 2013 the Washington Times reported on members of the Mexican Drug Trafficking Organizations making false claims of credible fear as a means of entering the United States:

On December 12, 2013 the House Judiciary Committee conducted a hearing on the subject:

Asylum Abuse: Is it Overwhelming our Borders?

While the hearing focused on the impact poltical asylum fraud committed by members of the Mexican drug cartels had on the situation along America’s southwest border, political asylum fraud and other examples of visa and immigration benefit fraud permeate the entire immigration system and impact all of the United States.

The lack of integrity to the immigration system imperils the future of our nation and the future of our citizens, undermining national security and the survival of the middle class. The time has come for our elected representatives shift their lazer-like focus from the southwest border and consider all of the other parts of the dysfunctional immigration system.  Most of what is wrong with the immigration system can be solved by COMPILE (COMprehensive Immigration Law Enforcement).
