"Manager for Violent Fraudulent Document Ring Sentenced to Two Life Sentences for Murdering Rival Vendor"

Once again I am addressing a recent article I posted on the CAPS (Californians for Population Stabilization) website in my commentary.  Today the article that forms the predication for my commentary deals with the successful investigation and subsequent arrest and prosecution of Edy Oliverez-Jiminez, aka “Daniel,” Erasmo,” “Ulysses” and “Jesus,” an individual who ran a violent fraud document ring that operated in 19 cities found in 11 states.

One of the most serious issues that involve the immigration system is fraud.  Fraud should be thought of as having two guises- fraud documents and fraud schemes.  Fraud schemes involve conspiracies that enable aliens to acquire visas and lawful immigration status by creating the illusion that the alien in question is eligible for a particular immigration benefit by lying on his (her) application for that immigration benefit.  There are all sorts of such criteria that can be used to achieve lawful status where fraud may be involved but to cite two of examples, consider marriage fraud where an alien marries a United States citizen or lawful immigrant but does not actually live with his spouse.  A number of movies have been based on this premise.  Another example is the alien who claims to possess a particular skill, profession or trade while, in reality, does not have those essential skills or where a false claim is made that there are no readily available American workers who could do that job for which the alien is provided with a visa.  

There are other such fraud schemes that are often employed by aliens who seek to game the system including political asylum fraud.

The other guise that fraud may take involves the use of fraud documents as a form of camouflage, to conceal an alien’s true identity and create the illusion that the alien is a United States citizen or lawful immigrant so that he can get a job or conceal his identity in furtherance of criminal or terrorist objectives.  The 19 terrorists who savagely attacked the United States on September 11, 2001 were subsequently found to have used more than 300 false identities or variations of false identities as an embedding tactic that enabled them to hid in plain sight.

The fraud ring that was dismantled in the case reported on in my article for CAPS involved the latter form of fraud- the creation and sale of fraud documents.

Generally when the issue of the creation of fraud documents is concerned, the presumption is that this crime is a so-called “White Collar” crime.  Such crimes are not often thought of as involving violence.  In this case, nothing could be further from the truth!

Time and time again, Janet Napolitano, the Secretary of Homeland Security has repeated the mantra that our borders are secure and there is no “spillover” violence from Mexico in the United States.  When you read the DOJ and ICE news releases, you will quickly see that Ms Napolitano either does not know what is really going on or she is guilty of being disingenuous.  (Disingenuous is a polite way of saying LYING!)

This is why I have come to refer to the DHS as being the Department of Homeland Surrender!

This issue also raises another point that few are willing to address or consider.  We are constantly told that in order to capture the mythical “Latino Vote” politicians have to vote for amnesty for unknown millions of illegal aliens thereby providing them with a pathway to United States citizenship.  Similarly it is often stated that Latino voters oppose the enforcement of our nation’s immigration laws and that those who insist on the enforcement of those laws and the securing of our nation’s borders are “Anti-Immigrant,” racist, or worse!

In point of fact, when illegal aliens run our nation’s borders there is no way of knowing why they have surreptitiously entered our country or what their backgrounds are.  There is no record or their entry and it is a simply matter for them to head to any town or city and set up shop- including those who would do serious harm to our nation and those who live within the communities to which they move.

We also must come to understand that the impact of illegal immigration can and, in fact, is felt in cities from coast to coast and border to border.  The impact includes loss of jobs and other economic problems but is not limited to these issues.  Indeed, lives are all too often placed at risk!  Ironically, those most at risk to the violence associated with transnational gangs are the members of the same ethnicity as the gang members.  While this case involves Mexican criminals (incredibly an important fact ignored in the news releases- presumably at the behest of the administration) the same pattern can be found in virtually every ethnic immigrant community. 

While the successful investigation and prosecution of the players in this document ring is worth crowing about, the reality is that there are likely hundreds, if not thousands of other fraud document rings operating across this country posing not only a threat to the integrity of the immigration system for purposes of illegal employment, but posing a threat to national security.

Incredibly not a single politician has said a word about this huge vulnerability in the immigration system.  If you listen to the statements made by nearly every politician who is willing to even speak about immigration, there are generally two issues that are raised- the U.S. / Mexican border and the issue of the employment of illegal aliens.  When aliens are able to game the immigration system they are able to secure employment and move easily across our nation’s borders.

Where the immigration system is concerned- you must think of a boat floating in the middle of a lake and ask a simple question, “How many holes must a boat have in it for the boat to wind up at the bottom of that lake?”  The answer, of course, is “One!”  Fraud is not only represents one of those holes, it is a gaping hole at that!

Show me a politician who refuses to enforce the immigration laws or attempts to trivialize these laws, and I will show you a politician who needs to find out what it is like to stand on the unemployment line!

Benjamin Franklin, in discussing our then fledgeling nation, said that they had given us a republic if we could keep it!


What he was making clear was that this democratic republic required that its citizens take their citizenship seriously and keep the political leaders accountable.

It is time for the citizens of our nation to make certain that our nation’s leaders, on all levels, to come to terms with the fundamental fact that the purpose of our immigration laws is to protect our nation and our citizens from aliens whose presence has the potential to have a serious adverse impact.  Ignoring those laws exposes our nation and our citizens to a variety of serious threats and challenges ranging from national security and criminal justice and public safety to the economy, the environment, healthcare and education!

A country without secure borders can no more stand than can a house without walls!

I

our country is to survive and if our children and their children are to get their share of the “American Dream” the citizens of this nation must take their citizenship seriously!

We the People must be the best citizens we can be, citizens who are worthy of the gallantry demonstrated by our valiant men and women in the military, law enforcement and firefighters, who routinely go in harm’s way in defense of this nation and our citizens.  
My goal in writing this and other commentaries is to point out our nations many failings before more victims pay the ultimate price for the incompetence and ineptitude of our government.
The first step in problem-solving is to first identify the problems and vulnerabilities and then devise strategies to overcome them.

The practice of good citizenship does not end in the voting booth, it only begins there.

For far too long our citizens demonstrated apathy which emboldened elected representatives to all but ignore the needs of the average American citizen in a quest for massive campaign funds and the promises of votes to be ostensibly delivered by special interest groups. 

I am encouraged that more and more of us, We the People, are not willing to simply sit on the sidelines anymore!


I believe our nation’s is greatly benefited by the rich diversity of our people which is why I could never imagine living anywhere except New York City, arguably the most diverse city in our nation if not, in fact, the world.  However, my idea of diversity most certainly does not include members of MS-13, the Mexican drug cartels or members of other transnational gangs or members of al-Qaeda!

I also believe that the original purpose of our nation’s immigration laws need to be be brought “front and center” to make certain that our nation does not permit the entry of aliens into our country whose presence in our country is problematic for the citizens of our nation and that if such aliens do succeed in entering our country that our nation have the resources, integrity and dedication to do everything possible to make it impossible for such aliens to function within our country so that even if they are not apprehended, they will find it pointless to remain in the United States.
As I have noted on a number of occasions, “No one would break into the amusement park if they could not get to go on the rides and no one remains in the amusement park at the end of the day when they turn shut down the rides and turn off the lights!” 

If our government’s failures to secure our nation’s borders and effectively enforce our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!

Manager for Violent Fraudulent Document Ring Sentenced to Two Life Sentences for Murdering Rival Vendor

A news release issued on March 2, 2012 by both the Department of Justice (DOJ) and ICE (Immigration and Customs Enforcement) addresses the imposition of two life prison sentences on a key player in a fraud document ring that used acts of extreme violence committed within the United States as a means of protecting his turf; turf to be found in 19 American cities located in 11 American states.  Meanwhile, Janet Napolitano, the Secretary of Homeland Security continues to insist that there is no “spillover violence” in the United States from Mexico.

The opening paragraph of the Justice Department news release does a good job of laying out the salient facts about this case:

WASHINGTON – Edy Oliverez-Jiminez, aka “Daniel,” Erasmo,” “Ulysses” and “Jesus,” 25, of Virginia Beach, Va., was sentenced today to two consecutive life terms on prison, after having been convicted by a jury for racketeering, murder, kidnapping, conspiracy to commit money laundering and conspiracy to produce and transfer false identification documents.

It is disconcerting that Oliverez-Jiminez was convicted of exporting the violence of a “Mexican-based cartel,” yet there is nothing in either news release about the citizenship of either Oliverez-Jiminez or his co-conspirators who were operating in 11 states scattered around our country.  Consider this quote from the ICE news release:

“Oliverez-Jimenez was a long-term supervisor for a highly sophisticated and violent fraudulent document trafficking organization based in Mexico, with cells in 19 cities in 11 states, including three cells in Virginia. Prior to his arrest, he had served as the cell manager for the Virginia Beach and Little Rock, Ark., cells.”

When transnational gangs set up shop in communities in the United States, the cells that are established are run by aliens who are citizens of the country from which the criminal enterprises originate.  This is about maintaining strict control through the use of extreme violence.  Consider this passage from the news release:

During Oliverez-Jiminez’s trial and Cruz Millan’s sentencing hearing, the United States presented evidence regarding Cruz Millan’s orchestration of the kidnapping, beating and torture of an enterprise member who was suspected of stealing from the organization. The event occurred on Oct. 29, 2010, in Raleigh, N.C.  The evidence presented included telephone calls during which Cruz Millan conducted a “conference call” with other cell leaders around the United States so they could hear the torture as it took place and sending a message to other enterprise members about what would happen if they were caught stealing from the criminal organization.  The testimony and intercepted calls depicted how the victim was subjected to electric shocks administered by placing his feet in a bucket of water and electrocuting him with jumper cables attached to a car battery.

It should be presumed that Oliverez-Jiminez is a citizen of Mexico, but the current administration has consistently been reluctant to identify criminals’ immigration status, apparently concerned that if the public knew how many criminal aliens were operating throughout the United States, at great distance from the Southwest Border, that more American across the country would demand that our borders be secured and our immigration laws be enforced.

This case represents only one such organization that was identified and dismantled through the diligent efforts of the various law enforcement organizations that participated in the investigation.  It must be remembered that fraud identity documents not only may be used to permit illegal aliens to seek unlawful employment but may also be used by criminals and terrorists to enable them to hide in plain sight.
